While the Government talks about legal clarity, it does not pursue this uniformly in practice, but instead is captured by whichever “stakeholder groups” shout loudest. Likewise, although it champions equality, protections are advanced unevenly across different groups.

Labour (whether it is under Starmer or his successor) must decide whether they will uphold a more muscular liberalism, one that seeks to balance the rights of all, and is willing to take the decisions necessary to defend that stance with conviction.

Enforcing sex-based rights for women and girls is one of the most straightforward tests of its integrity in this matter, but it is a test that it is currently failing.
