Scottish Government to take on FWS in new trans court fight

The Scottish Government has confirmed it will challenge For Women Scotland’s legal bid to remove guidance that allows male-born prisoners to be housed with women and permits transgender pupils to use single-sex facilities and sports in line with their gender identity.

The group’s summons, served on Scottish Ministers, the Lord Advocate and the Advocate General, was formally called by the Court of Session on September 10 after ministers failed to withdraw the policies within the 21-day deadline. Government lawyers have now confirmed they will appear in court to defend the guidance

I love and admire FWS and I’m pretty sure they’ll get the victory they deserve. But dear God, I wish they didn’t have to fight for women’s rights and safety every inch of the way.

Same here but the silver lining to this is we can expect the hearing and judgement to come right before the Scottish election so it should help get rid of the snp

That's just it, isn't it? There will forever more be another legal challenge - or the intention of it - which will mean no-one can possibly change their policies until it's been decided Hmm

I can’t possibly imagine the grounds in which the Scottish govt think they can possibly challenge this.

Do they just really really hate women (particularly those in prison), or is there some extremely juicy Kompromat floating around that ensures their co operation in this matter?

Yes - they use our taxes to try to undermine us and then we have to donate to organisations willing to stand up for us. They really, really hate women.

That is not true at all, for a devolved government. Sure the UK parliament could if they so chose negate the Supreme Court FWS ruling, by legislation, but the Scottish Government has no such power.

There are some people who are aiming at achieving this, I suspect. The Scottish government may be a Trojan horse.

Is there any point in writing to anyone on this you do you think? To say as a Scottish taxpayer I do not consent to my money being pissed up the wall on a legal case that will be lost when public services are in a dreadful state and there's apparently no money to fix them? And this coming after all the money spent on losing the original case against FWS, not to mention NHS Fife v Sandie Peggie. FFS

I haven't a clue how I'm going to vote in May.

Greens - actually evil and apart from that, shite on environmental stuff. I'd rather vote for the 'We Love Satan' Party

Lib Dems - apart from the 'did it all for Beth' and Christine Jardine crap, it's basically the 'Tory Lite' option for high earners who agree with Tory policies and who can't quite bring themselves to vote for Labour. They can preen their social progressiveness while not actually having to lose anything.

SNP - eh, no. Absolutely shite. Captured and incompetent.

Labour - craven and unprincipled. With very few exceptions, will obey a whip without question, even on things which are clearly wrong.

Conservatives - have been far and away the best on the self ID issue but I can't agree on their policies.

Alba - never going to get anywhere.

Others - too mad or too right wing for me.

Unless the principled, unafraid to face criticism MSP's from all parties unite to form their own cross party party, we're fucked.

No, there would have to be a referendum, according to the Scotland Act.

@Waitwhat23 my MSP is great and I will vote for her, but I feel your pain. I spoilt my ballot in the Westminster election (and on the doorstep I told my SNP candidate and Labour rep exactly what I thought of their anti-women policies).

Is ScotGov planning to argue that the SC ruling does not apply to prisons and schools, because they are governed by enactments outwith EA2010? They are risking spreading the SC interpretation of sex all around the statute book, which would be great!

Ooh, this sounds like a good plan. Hopefully this will end with all perceived gaps being stopped up.

The Scottish government can’t possibly have a compelling legal argument to allow men in women’s spaces in either schools or prisons so they will just lose and create useful confirmation of the law.
