  • The EHRC is writing to 19 organisations following a government "call for input" that identified 404 examples of potentially problematic guidance.
  • The organisations were identified through a triage process that assessed potential breaches and their seriousness, considering factors including severity, organisational size, persistence, and potential impacts on vulnerable groups. The list was further refined to include only organisations that still maintained concerning policies as of last month. This does not indicate that other organisations may not also have policies requiring review.
  • The organisations span policing, education and other sectors including health and public services.
  • The EHRC is currently updating its code of practice for services, public functions and associations, which will provide comprehensive guidance following the Supreme Court judgment in For Women Scotland v Scottish Ministers which clarified that the terms "man", "woman" and "sex" in the Equality Act 2010 refer to biological sex.
  • Trans people continue to be protected from discrimination under the protected characteristic of gender reassignment.
  • As part of its Strategic Plan 2025-28, the EHRC will improve compliance with the Public Sector Equality Duty (PSED) by undertaking a programme of monitoring and engagement to increase compliance and ensure that public authorities are seeking to eliminate unlawful discrimination, promote equality of opportunity and foster good relations between groups.

What with a male doctor saying he would expect other staff to bring him to a woman who asked for a female doctor and the senior ED staff wanted to call the police and have a nurse arrested for refusing to see him as a female doctor.
