Can we keep a list of restaurants, bars, gyms, service stations, shops etc. that have toilet/changing provision that could disadvantage women.

Especially places where they have changed signage on both previous men’s and women’s to unisex where it disproportionately reduces provision for women.

Or new builds that have an enclosed room with multiple cubicle doors with shared sinks within the room.

It would be helpful if anyone could draft a short standard letter regarding the potential legal discrimination for not providing single sex if possible.

We could then email the letter quickly and easily to all noted places.

It would be helpful to explain the provision and a link to their website.

It could be indirect sex discrimination against women if the only provision is mixed-sex.

You could start with schools. On the current DfE school specific brief there’s this on p.48/49

Walmer castle today. Used to be a ladies now a unisex loo. They did have single sex toilets in the garden but the first ones you come too are mixed sex. Two or three loos and sinks outside so not enclosed loos.

  • Toilets are located on the castle grounds.Male, female, and accessible bathrooms are on-site. Baby-changing facilities are available, located near the Kitchen Garden.

So they advertise male and female. Do you know if there were other single sex in addition to the ones you saw?

We can email in if you can confirm

I might be useful to have this to hand, as it gives the definition of what a 'proper' universal/unisex toilet is - and it isn't an existing one with a new badge stuck on the door:

Toilet accommodation
T1. (1) Toilet accommodation in buildings other than dwellings—
(a) must consist of—
(i) reasonable provision for male and female single-sex toilets, or
(ii) where space precludes provision of single-sex toilets, universal toilets, and

(b) may consist of universal toilets in addition to single-sex toilets.

(2) In this requirement— “single-sex toilet” means toilet facilities which—
(a) are intended for the exclusive use of persons of the same sex, and
(b) provide washbasins and hand-drying facilities in—
(i) either the toilet room or cubicle, or
(ii) a separate area intended for use only by persons of that sex.

“universal toilet” means toilet facilities which—
(a) are provided in a fully enclosed room which contains a water closet and washbasin and hand-drying facilities, and
(b) is intended for individual use by persons of either sex.

Toilet accommodation: Approved Document T
