NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #47

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Oh, I don't know any more. Was it a menopause policy? The phrase I recall was "menstrual privacy stuff". I guess I'm feeling disappointed in, and alienated from, SP because of the racism allegations turning out to be at least somewhat well-founded, and now not sure what to think. She's still entitled to a sscr of course.

They package up all the evidence put it in a sensible order and tell the judge all that orally, rather than sending him it in writing.

JR's case is that she went there at that time deliberately, in order to have it out with BU. Can you put your hand on your heart, given the message she posted about having been looking up menstrual privacy, and say you're 100% certain that isn't true? I'd like to believe her, but right now, I'm not 100% sure I do.

But what would have been so wrong about that anyway ? If she wanted to address it with him why wait ?

As a Chinese person with immigrant parents who owned a Chinese takeaway. Yes, a getting chinky for your tea is a Scottish term amongst the working class families who I lived amongst. Not a big deal for me and I don’t need other folk speaking on my behalf. I call myself takeaway kid, BBC and a Banana because it reflects my lived experience. I am Sandie’s age.

And it is entirely IRRELEVANT to whether women should have single sex spaces for themselves. Ignore the sideshow, it cheapens everyone. And I, for one, am tired of performative hand-wringing. I want women-only spaces and happy to include SP in them as she is a woman and that is all that concerns me in this matter. The rest is noise and a desperate attempt to conflate two issues. In a legal sense, they remain two distinct concerns and SSS is what this tribunal is meant to be deciding on.

Racists aren't always able to hide their racism all the time.

You really are being unpleasantly obsessive about this. Thankfully the British justice system isn't organised around giving people justice depending on their overall moral purity,otherwise no-one would ever get it. If she wins, Sandie's compensation will depend on the degree of detriment the tribunal panel decide she has suffered, not on her political or any other views and opinions.

I think NC called SP to clarify who else objected to DU in the changing room and to reduce the effect of the racist jokes. NC really had to show it was a usual pattern of speaking for SP and not that she intended racism. Not sure how successful that has been.

I think whoever else was in the chat and wanted to give evidence may have withdrawn after seeing how LN’s words were thrown back in her face.

It's fine to be disappointed.

Meanwhile, Sandie was of an age where menstrual flooding is a common experience, to the extent that its realistic any woman might think about it happening in work. She also had a male colleague whom she knew had been told he could use the womens.
