On 18 July 2025, NHS Fife released a media statement that referenced the Commissioner's Decision 133/2025. In response, Scottish Information Commissioner, David Hamilton said,

“The petulant tone of NHS Fife’s latest statement is quite remarkable but it is the contents that concern me most. They have now cast doubt upon the assurances they gave me regarding compliance with my Decision Notice. I will investigate further and if the Authority has not indeed fully complied with my Decision then I may report the matter to the Court of Session as a contempt of court.”

The overall impression of NHS Fife is one of sheer disbelief. They have created a huge hole and they can’t stop digging.

All they have done is to create even more awareness of the shit show they have created. If you have a spare couple of hours just go onto Twitter- Tribunal Tweets to read the carnage they have created. Or go onto the Scottish press web sites for some good summaries.

Safe to say that NHS Fife will be an excellent case studies in the importance of

  • having policies and in place which are known by all staff
  • looking after information
  • following procedures that are fair
  • taking minutes in meetings
  • when writing an e-mail to think how it might sound in an employment tribunal
  • how to treat all staff fairly
  • how to write and issue a press statement without becoming a national laughingstock
  • how not to piss off the Scottish Information Commissioner to the tune that your press statement is described as petulant
  • how not to piss off an employment tribunal panel
  • having good training for all those involved in DEI, HR, Legal, main board etc. Actually any management position in NHS Fife.
  • how to recognise when you should just shut up and say sorry before the whole country and beyond see you as a laughing

obviously that list is not exhaustive because no sooner do I think the shambles can not get any worse it does.

Tbf long before they qualify very medical person of any type has been taught about the risk of ending up in court as basic training on why you record everything.
Eg going so far as to only write in black ink and ensuring that the ink medium will not fade over time.
