So The Women's Prize has said that transwomen are eligible to win in 2026. Is this legal or is it discrimination against other men?

It looks like illegal discrimination against men who are not undergoing gender reassignment. It's the publisher who enters the book for the prize so it would need the co-operation of a GC publisher to bring a claim. On the other hand perhaps a stiff letter from the EHRC pointing out that they are breaking the law will be enough to get them to see the error of their ways.

Section 158 applies if a person (P) reasonably thinks that—
(a)persons who share a protected characteristic suffer a disadvantage connected to the characteristic,
(b)persons who share a protected characteristic have needs that are different from the needs of persons who do not share it, or
(c)participation in an activity by persons who share a protected characteristic is disproportionately low.
This Act does not prohibit P from taking any action which is a proportionate means of achieving the aim of—
(a)enabling or encouraging persons who share the protected characteristic to overcome or minimise that disadvantage,
(b)meeting those needs, or
(c)enabling or encouraging persons who share the protected characteristic to participate in that activity.

The prize must be for people who share a protected characteristic. Women, and men with the protected characteristic of gender reassignment, do not.

It can't be described as a women's prize if non women are eligible. So they'll have to change the name.
