I just caught the end of this, with Piers Brosnan tearing a strip off the BBC for its coverage of gender issues. It's not up for streaming yet, but should be enjoyable

I'm not sure enjoyable's quite the word I would use, my throat's still a bit sore. I did enjoy hearing Piers actually saying things out loud though! What a refreshing change, on the BBC.

It was Piers Morgan not Piers Brosnan (007!)

I was troubled by the BBC legal bod saying that it still wouldn’t be ok to say trans women are men (https://murrayblackburnmackenzie.org/2024/03/01/the-bbc-ruling-on-justin-webb-ignoring-public-confusion-and-scientific-fact/) unless you caveated it with lots of “in the limited sense of the EA Act”. And that the judgement had said that you had to use the preferred pronouns for trans people.

The judgment didn't say that you have to use people's preferred pronouns, although at para 111 it described the Employment Appeal Tribunal's comments in the Forstater case: "The EAT commented that if the claimant gave expression to her beliefs by refusing to refer to a trans person by their preferred pronoun, that could amount to unlawful harassment in some circumstances, although it would not always have that effect."
It is not immediately clear to me whether this constitutes an endorsement of the EAT's comments, but even the EAT said that it would not always be unlawful to refuse to use preferred pronouns.

I don't like Piers Morgan but that was very refreshing. Jane Fae sounding world-weary as usual. Clearly expects to be treated as a wise old elder. Pronouns must be respected, apparently, as it's just polite. Come on. If someone tells me a blatant lie, why do I have to respect that? Surely obvious inaccuracies, at odds with reality, are not worthy of respect in a democratic society.

Jane Fae seemed to say that transpeople had been attempting to whistleblow about the Tavistock. Did I mis hear this? And if so, when, I can’t remember them doing that? Unless it was to complain that they weren’t medicalising children fast enough.

This was in the context of Justin Webb clarifying that a transwoman was male in a context where the whole point of the piece was that they were male, then getting a complaint against him upheld for doing so. This legal bod implied that even in that circumstance it was not sufficient "context" to make describing a transwoman as male OK.

I commented on the other thread but it has disappeared.

That upheld complaint against Justin Webb was ridiculous then and even more so now.

Hannah or Rosalind got across the point that most journalists have not touched this topic so it hasn’t had the usual scrutiny in the media, and only ‘comment’. Also refuted the TIM’s point that it was incredibly rare for male sex offenders to want to be addressed as women.

overall an interesting listen.

I really like Hannah Barnes, I always think she does a sterling job of sounding very fair and reasonable to a neutral listener while clearly being TERF to her bones.

I forget who it was, but one of the BBC people (the legal correspondent Dominic?) commented that he'd never encountered another subject so many journalists refused to work on. All terrified of getting it wrong, I think he said, or maybe just the amount of scrutiny and attention it would bring with it. Not a great look for the fearless BBC, tbh!

A lot of rewriting history from several contributors.

Apparently the Bench book has always been that if a judge thinks an accused rapist is pretending victims won’t have to use their preferred pronouns. Tell that to the poor rape victims forced to use she.

Piers Morgan rightly calling them out.

What was interesting is the real fear that exists across the media of reporting on this issue. It makes those who have stood up and reported on the issue even braver than we realised.

In 2020 an employment tribunal had a two week hearing into whistleblowing at the Tavistock. The resulting judgment does not obviously support Jane Fae’s claim.
