Statement by our Solicitor Peter Daly from Doyle Clayton - For 15 months, I've been advising a group of women who play competitive Pool, seeking to establish women-only competition in their sport. This resulted in the statement last night from Ultimate Pool that women-only Pool is being re-introduced. My clients' statement is here:

It draws extra attention to the point that many people feel strongly enough about women-only categories in sport, and other areas, to put their own money towards establishing that they are possible. This counters the idea that it’s not just backed by a few wealthy donors.

The EBPF have their own report pertinent to their case. Even if we could share at this time (cannot be released until agreed by all parties), the court case has already been heard and awaiting judgement.
The Judge who resided on the EBPF case referred on a number of occasions to the Supreme Court Judgment stating that the outcome may deem the case of no matter. Not entirely sure what he meant but will find out soon.

"Gender affected" is the term used in the Equality Act. Although since it also talks about "sex" in the same section, it's very clear the two are meant to be synonymous:

"A gender-affected activity is a sport, game or other activity of a competitive nature in circumstances in which the physical strength, stamina or physique of average persons of one sex would put them at a disadvantage compared to average persons of the other sex as competitors in events involving the activity."

Sex refers to biological attributes whereas gender refers to identity. Trans women are still protected under the EA 2010 as before, the EA was not changed by the Supreme Court Judgement but the definition of sex as a biological women defined in law. We had to prove that pool is a ‘gender-affected activity/sport based on biological attributes of sex and were successful in doing so. Hope I explained it well. The report will hopefully make it clearer when it can be released.
