Has anyone noticed the India Willoughby post on X, re-tweeted by For Women Scotland promoting the #pee4me “mass” demonstration tomorrow in Parliament Square in protest at the SC “removing legal protection from women who are trans”. A mass public urination on Easter Sunday will certainly win over the British public.

On reflection, is this overt defacement and vandalism on a par with what the Fawcett Society has itself done to Millicent’s legacy?

Yup. Case by case meant that each group that wanted to exclude one sex, had to be able to justify why that was necessary in their case.

Stonewall spread the lie that case by case meant women’s groups had to justify excluding each and every man whi claimed he was a woman individually on a case by case basis.

They really were slippery in every way and I’m glad it backfired on them. They are, in large part, the creators of this mess, and just think how much money they’ve pissed away (to coin a phrase) wasting ten years pushing lies, only for it all to be revoked by this wonderful court case.

The proportionality assessment applies to whether it would be proportionate and a legitimate aim to have a single sex space. The Equality Act says that IF it's proportionate and legitimate to have a single sex space then it is not sex discrimination to exclude men from that space. The Equality Act also says that if that same single sex space is proportionate/legitimate, then it's not discrimination on the basis of gender reassignment to exclude trans people from that space. This means that both all males, whether they are trans or not, can be excluded from female only spaces so long as the space itself is proportionate/legitimate.

If it's not proportionate,or if the single sex space doesn't pursue a legitimate aim, then you exclude men or transwomen from the space without it being discriminatory.

The key take away is this. If a space is a single sex space, and it's proportionate/pursues legitimate aim, then BOTH men and transwomen must be excluded in order for it to remain a single sex space. If you admit transwomen to the space, but not men, this is discriminatory towards men as it has become a mixed sex space and there is no good reason to exclude one section of males but not the other. It is no longer possible, under the Supreme Court's interpretation, to have a situation where 'cis men' are excluded from a female space but 'transwomen are included' . Either all males are allowed in a space (in which case it's mixed sex) or all males are excluded (in which case it is a single sex female space).
