Trans people still protected by the EA - yes of course, in their legal relationship to the state, and no woman here ever wanted otherwise!

But equality cannot mean trampling women who don't share the belief that a man is a woman because he tells her so. This is absolutely not one group triumphing over another, it's women fucking relieved that they're not subordinated and removed in law by men with zero care or respect for anything but their own wishes. It re establishes equality.

But to activists, women having equality of consideration to them, and an equal right to words and spaces of their own is 'hate', so this will go down like a bucket of cold sick.

Your third paragraph particularly: YES.

The adults are finally returning to the room. On the face of it a victory for sanity, science and sheer commonsense. I expect the trans' lawyers are even now sharpening their knives to spot any tiny loophole.

Surely the Commons cannot do anything with new laws to reverse/weaken this can they? Sometimes the world is consumed by madness - politicians included. Let's hope we are finally rowing back from the new religion.

I feel sorry for any transgender person who is saddened by today’s ruling. I think the judge was wise to say that this shouldn’t be celebrated as one group triumphing over another.

But my overall feelings are of relief, that common sense has prevailed, and that women are defined as such to the exclusion of those who simply feel that they are women.

To those people I wish you love and respect, and you have my sympathy for being in a position that I can imagine is very difficult for you. But you are not women.

Trans men are women! And thanks to this ruling any of them who wants to give birth will not lose their right to legal protections in pregnancy and maternity. This is a good thing!

They legally can use their own sex's or mixed sex toilets in their acquired gender, free from discrimination, harassment or abuse.

Woot. They've won too. It's now recognised that they have this right (that they always had).

The 'trans rights' and 'equality' line has always been based on that a man with a chosen identity (and/or certificate) is a part of the sex class of women, and to say otherwise or to try to separate biological women as a group is like rejecting/excluding disabled women etc. We've seen the awful attempts to argue that.

There is no failure of equality or missing 'right' if women are a biological sex class that no man belongs to regardless of circumstance of that man.

Hopefully judgements like this will empower more people to do this.

Let's hope so. I'm still quite hesitant in real life despite the mountain of legal wins behind us.

Interesting and better than I'd expected. Good that the Scottish government's position has been shown to be thoroughly wrong and that a woman has to be born a woman.

I have concerns as to what this means going forward. The ruling suggested to me that we're still going to be in an impasse. Women's spaces are now protected but trans people can't be discriminated against. What does that mean in prisons for example? It sounds now like transwomen can't be sent to women's prison, but they have protection from going to men's prison because that would lead to discrimination.

It now appears to me that we're still in a dangerous mess. Above all, the whole thing is reliant on points of law. Laws can be changed - the ruling here mainly says that the Scottish government acted wrongly, but Westminister is still controlled by a man who can't say whether a woman has a penis or not.

Yes this ruling is better than most of us hoped for, but while transpeople have loud voices and have their own legal protections there remains a risk that what's good news today might not be tomorrow.

Surely this mean that if a TW is not allowed in a women’s prison because he is not biologically female, then he can’t be discriminated against in a men’s prison because he is TW? If so, it will be on the prison system to provide a safe space for TW which does not mean opening up women’s spaces. Similarly all other women only spaces - as a pp said - third spaces will have to provided, which is what we have all advocated for all along. The trans activists have consistently (and, I would argue, purposefully) ignored this fact - women do not hate TW, we are protecting our spaces from men, no matter how they identify. Otherwise live your lives in dignity.

exactly - public opinion / pr optics will be strongly against parliament trying to go against this - don't forget that the majority of people have always thought that a man is a man and a woman a woman - it is only a tiny majority that have shouted loudly otherwise

I think that trans women can still have their cake and eat it when it comes to discrimination claims.

They can use both their actual sex (male) and their perceived/associated sex (female) as the basis for a discrimination claim, depending on the circumstances, which is something that other people can't do.

What is interesting for women is that it should be more straightforward for a woman to bring a sex discrimination claim using a trans woman as her comparator. Because if a woman is trying to claim that she is not being paid equally to a man doing the same job, or that she was passed over for a job or a promotion on the basis of her sex, she would have difficulty if the person she wanted to use as her comparator is a biological male with a gender recognition certificate. This judgment clarifies that she can do that.

It also ensures that a trans man with a gender recognition certificate can also bring a sex discrimination claim using biological men as the comparator.

With regards to female spaces, we are in a situation where female only spaces are allowed, but not legally required unless it would discriminate against women not to have them - but as the providers of these spaces/ services are often trans activist dominated (such as councils) they have been ignoring the needs/ human rights of women due to Stonewall influence.

The Equality Act gives examples of changing rooms, hospital wards, abuse support - and we know that many places have given men who say they are women access to these. Currently women are being subject to appalling levels of voyeurism by males whatever their gender beliefs etc in eg mixed sex swimming changing rooms (these have often replaced SS changing rooms on trans lobbyists influence) where men have access to girls - and female victims of MVAWG unable to access any abuse support across the country.

It's a protection of rights.

They can't be discriminated against for wearing a dress for example (but since women would be pulled up for inappropriate clothing, they can too).

Stuff like that - where there's no special treatment either one way or another. As in, y'know, equality.

He explained it in the live ruling - basically if someone discriminated against them because they perceive them to be a woman (even though they're a transwoman) they would still be protected by the sex discrimination part.
