DA Compelled to Call Alleged Male Rapist "She/Her" - California

Tremaine Carroll, 51, a trans-identified male formerly incarcerated in a women’s prison, faces charges including two felony counts of forcible rape and one count of dissuading a witness - incidents that are alleged to have occurred in January 2024.

WoLF attended the People v. Tremaine Carroll preliminary hearing in Madera, California, in early July. The hearing determined there was enough evidence to proceed to trial. Our Executive Director Sharon Byrne and WoLF supporters protested the inhumane conditions that force women to be confined with men in prison cells, yards, and showers.

During the hearing, Mr. Carroll asked his attorney to require the prosecutor to refer to him by his "preferred pronouns" of she/her. DA DuTemple objected and was told he could file a brief, and the judge would consider his arguments in a later hearing.

Yesterday, the judge made a final decision: DuTemple has to refer to the alleged male rapist as a “she/her” during the trial.

Um. So this man raped a woman and threatened another while housed in the women's jail? And now must be referred to with female pronouns?

I don't know why they're wasting the court's time with a trial. Why not just ask this rapist what he wants, and simply give it to him? They've already established the principle that reality is not relevant, honesty in court is not relevant, his victims are not relevant, his potential victims are not relevant, and that his desires are vastly more important than anything else.

I think this is what is so disgusting.

Why in a trail, especially given the crime, should anyone be compelled to use words that are only promoted by a small group of believers.

Is any other belief group allowed to dictate to people like this, and have a Judge enforce it.

How is this even compatible with First Amendment rights to freedom of speech, belief and thought? It's compelled speech to impose a belief.

That judge has acted against the DA's first amendment rights - surely there is some way to have them recused?

If I was forced to do that I'd use names most of the time but occasionally use pronouns but state I was being compelled to lie by the judge prior to each and every use of wrong sex pronouns
