Several Republican lawmakers introduced legislation to clarify that the terms “male,” “female,” and “sex,” among others, refer to the biological distinctions between men and women when those words are used in laws.

The Defining Male and Female Act of 2024, introduced by Sen. Roger Marshall from Kansas, aims to prevent government officials and courts from reinterpreting those terms through the lens of gender ideology by identifying men and women based on self-identification instead of biological distinctions.

Marshall said in a statement that he “didn’t think we would need legislation to tell us that there are only two sexes, male and female, but here we are.”

According to a news release, the legislation would restore the legal right to reserve girls’ and women’s sports and scholarships for biological girls and women. The news release also states that the bill would restore the sex separation of restrooms, locker rooms, dorm rooms, prisons, and shelters for victims of sexual assault.

“As a physician who has delivered over 5,000 babies, I can confidently say that politicizing children’s gender to use them as pawns in their radical woke agenda is not only wrong, it is extremely dangerous,” Marshall said. “We must codify the legal definition of sex to be based on science rather than feelings. With our legislation, we can fight back against the Biden-Harris administration’s assault on our children.”
Sen. Mike Crapo, R-Idaho, said in a statement that “men and women have biological differences that must be recognized.” He added that “women and girls deserve to feel safe and respected in all spaces, public and private.”

The legislation is designed to unwind policies that were enacted during the administration of President Joe Biden and Vice President Kamala Harris.

Under the current administration, the U.S. Department of Health and Human Services (HHS) reinterpreted the Affordable Care Act’s prohibition on “sex” discrimination to include any discrimination on the basis of so-called “gender identity.” The rule was blocked by a judge but would have forced health care providers and insurers to cover transgender drugs and surgeries for both adults and minors.

The administration also revised Title IX regulations to redefine sex discrimination to include any discrimination based on gender identity. This could have forced publicly funded schools and colleges to allow biological men in women’s locker rooms, dormitories, and athletic competitions. However, its enforcement is limited after multiple courts blocked implementation.

I suspect this will be treated with suspicion by some because it seems to have the backing of churches.

Strangely, here we like to consider things issue by issue - so we can support women’s rights, both to reproductive health and single-sex spaces. You should try it - it makes for a far less angry, polarised society

Welcome to the board. Although you're being teased for your accent you will find many on here were taken aback to be agreeing with Republican supporters on something. For a lot of us there was one thing which 'peaked' us. For me it was realising that the authorities genuinely were putting men who identified as women in women's prisons - combined with the information that men's rate of sexual and violent offending remained the same even if they 'identified' as a woman. I'm not a stupid person but I was always inclined to trust that those in authority know what they're doing. Such a clear example of the fact that they don't know what they're doing, and that women were being put in danger because of it, finally awoke my sleeping feminist and here I am.

A slightly cautious welcome to this news. It will be brilliant to have all the protections for women and girls to be reserved only for women and girls. I would like to see it clarified to further decree that no organisation that offers services, opportunities or protected spaces for women and girls should deny any of those so someone with female biology who has a masculine or nonbinary gender identity or presentation. I don't trust the republicans to be using this kind of measure to enforce gender-conformity, which is just as anti-feminist as the TRAs.

This legislation comes from the red/green intersect in this venn diagram but the people who will set the exact wording fot how the legislation will be implemented are just as keen on the red/yellow intersect that is abhorrent to feminists

To be a Trans Rights Advocate IS to enforce gender-conformity. That is what 'gender' is all about, the enforcement of sex-role stereotypes (with side orders of homophobia and misogyny).

The thing I have found most interesting in the last couple of weeks to see two separate statements (from Nancy Mace and from the leader of Aontú) that being pro-life (and anti-abortion) is compatible with recognising that abortion may be necessary or appropriate in cases of rape or incest or when the woman's health is in danger, and that a limit of 20 weeks is reasonable. That is a long way from some 'pro life' positions in the past.

I cautiously welcome the bill, it's clearly talking sense and even if it doesn't get through immediately, it's a clear sign of the direction of travel in the US government for the next 4 years.

I’m so done with people wading in without a scrap of a clue about the logic of any position other than the one they’ve obediently adopted, and informing us that we are not feminists.

Then again, when I look back at myself 15 years ago on this particular issue, I have to acknowledge that I wasn’t a whole lot smarter.
