A transwoman applied for a gender recognition certificate and was refused by the panel. It went to judicial review and the decision was overturned and the transwoman got the certificate.
The panel were not convinced the individual was committed to “living as a woman” for the rest of their life because they had a non binary identity, and they wanted to keep a fully functioning penis. The individual came off hormone treatment for a while because they didn’t like the impacts it had on their sex drive and sexual performance. The panel thought that wanting to live as a woman with a male sex organ was odd, to say the least (while acknowledging that there is no requirement to have treatment or surgery to get a certificate).
The decision was overturned because the panel ignored the fact that the individual had a passport , driving license etc in a female name which was apparently conclusive of living as a woman and so that should have ended the matter.
the odd thing about this decision is it’s trivially easy to change your id and your name. It doesn’t really seem like a mere name change constitutes “living as a woman”, but that’s what the judgment says.
The transwoman has posted online that they are delighted with the decision, and say this is a big triumph as it shows you can live as a woman while still retaining a penis and being non binary.
it seems to me that the concept of “living as a woman” is entirely useless , and if you have id in a female name plus gender dysphoria that is sufficient.
