Swansea University has made it clear that it would much rather cancel this event with @MForstater, @HJoyceGender, @akuareindorf and @JoPhoenix1.

The only reason it is not doing so is to comply with the law.

I don't think they're right that gender critical views are 'a protected characteristic'. It's a belief worthy of respect etc etc, but not one of the nine protected charactistics.

Religion or belief is a protected characteristic under EA 2010, and an Employment Appeal Tribunal judgement found that critical beliefs met the grainger test, meaning that individuals who hold gender critical beliefs are protected, under EA 2010, from unlawful discrimination against them on the basis of holding that belief.

Swansea University would be in breach of EA 2010 if it discriminated against them because it objects to their gender critical beliefs.

The problem is that the only way to use the law in this instance is through the protected characteristic of belief.

Whatever C P Scott may have said (and the poor man must be whirling in his grave by now), facts are not sacred, sadly.

Looks like there is a TERF at Taliesin as this is, I believe the second or third such event to take place there. You can email them at [email protected] to voice your support of their continued commitment to free speech and women's rights.

When the Forstater case was being heard, that's exactly what I thought. I may have ranted about it a bit. And then I realised what a blinder had been played. Facts are being handwaved away, ignored, lied about. But 'beliefs'? Once the Forstater case had fully played out and her belief that there are only two sexes and humans cannot change their sex was affirmed as 'worthy of respect' - well, the facts might not be protected in law but the belief in those facts WAS!

But yes, it still fucks me off too. Facts should be enough.

It's a philosophical belief. Such beliefs are under the protected characteristic of 'Religion'. So GC views are protected.

I'm not entirely happy that scientific fact must be placed into the category of "belief", but we've got to work with the tools available.

The truth is they can't risk debating it because they have no argument that stands up to scrutiny.
