EHRC urgently reviews employer guidance on single-sex jobs

Equalities watchdog alerted that women’s refuges are ‘routinely’ and ‘unlawfully’ advertising positions to male-born applicants

The equalities watchdog is urgently reviewing its guidance for employers on single-sex jobs as women’s refuges are “routinely” and “unlawfully” advertising positions to male-born applicants.
The Equality Act has exemptions which allow employers to restrict a job role to a particular sex if they can show it is an “occupational requirement” and is “a proportionate means of achieving a legitimate aim”.
Under these rules, it is lawful for women’s domestic violence and rape charities to advertise female-only positions.
However, the feminist campaign group Fair Play For Women (FPFW) has alerted the Equality and Human Rights Commission (EHRC) to nine different charities which allow men who identify as women to apply for jobs reserved for female candidates.

EHRC now commits to enforce this law.

·If you see a job advert that’s restricted to WOMEN ONLY tell us if the employer says that includes:

Transgender women
Anyone who identifies as a woman
Anyone who identifies as non-binary

It’s unlawful. We’ll send any examples you find to the EHRC and demand urgent action

THREAD: This weekend the EHRC told the telegraph
it would "take action" and "enforce" the law to stop employers allowing men who identify as women to apply for "women-only" jobs.

This week we can put this commitment to the test /1

Fair Play For Women has now sent our 10th example of a discriminatory advert to EHRC. It runs until 26th March. We will be checking the status of this unlawful advert each day this week to see if it gets taken down or amended. /2

It is the job of the EHRC to make sure the Equality Act is understood and followed. Contacting the employer in question is a quick and simple task for a member of staff at the EHRC.

Will the EHRC do it's job? We'll find out this week. /3
