If they were the judge who wrote that rule that women have to call a male abuser ‘she’ when the abuser is a transwoman, then I have lost respect for them.

It is not only abhorrently cruel, especially given the stress of court, it is ridiculous. The very women who would have had to call transwomen/male abusers ‘she’ would also have been made to swear to tell ‘the truth the whole truth etc’

That aside, I was feeling sympathetic until I read the judge’s plaintif ‘peeing’, argument, when I feel sure someone in their position, by and large, would not have had any real problems.

I couldn't agree more, it's a blatant conflict of interest with evident bias in the guidelines.

I think this is the judge of the McCloud judgment which has potentially given a lot of NHS workers a better pension. So I'm grateful for that.

McCloud, an Oxford University graduate, said the rise of the “gender critical” movement — which holds to what she acknowledges is the “uncontroversial notion” that a person cannot alter their biological sex — has also meant that she can be referred to as a man, despite being legally female.

She argues that as a result, “it has been open season on me and others”. The judge, who will formally stand down in April, added that she feels that “the dignity of the court as well as personal dignity is at stake”.

Referring to men as men is reality-based and law should be based in reality.

I said in a previous thread that Master McCloud regularly posted many long opinion pieces on Linked In that clearly showed judicial bias. It's very clear that if you were gender critical, and appeared before Master McCloud there would be bias. It's very unusual: I don't know of any other judge who behaved in this way. I imagine what happened is it was made clear to McCloud that they would have to cool down the political posting, as it was incompatible with them being a judge. This was probably not appealing to McCloud so they quit. I do feel some sympathy, in the sense that if you have a strong sense of political activism it's really hard to combine that with being a judge. You just aren't supposed to express strong opinions about controversial issues.

IANAL but I think they brought the case to tribunal along with a firefighter, they didn't make the judgement themselves. I'm glad the outcome went the way it did for the sake of everyone who needed it though.

I wonder whether there is something in the pipeline that has triggered this.

The accusations of transphobia are typical, but I’m cynical when people resign when there’s no obvious reason for it and no obvious changes triggering their claimed reason for resigning.

The McCloud judgement refers to the Court of Appeal’s ruling that Government’s 2015 public sector pension reforms unlawfully treated existing public sectors differently based upon members’ age on the 1 April 2012.
The judgement came after two Employment Tribunals concerning the pensions of Judges’ (McCloud) and Firefighters’ (Sargeant) respectively.

The judge thinks 'gender identity' is a biological characteristic and not a belief?

Also seems not to understand that women have the protected characteristic of sex so why should those with a belief in gender identity manifest their beliefs to the detriment of women.
