Teenager told alleged rapist won't face justice despite Scottish Government review

A teenage girl whose alleged rape sparked a review of a government policy where offenders can evade prosecution has branded it a box-ticking exercise after she was told her attacker will never face justice.

The public outcry over her ordeal, revealed by the Sunday Mail, led to Scotland’s top prosecutor Lord Advocate Dorothy Bain ordering a review of the controversial guidelines.

The 18-year-old, who bravely came forward after he was allowed to walk free hours before he was due in court, was told last week the Crown was still refusing to prosecute.

The alleged rapist was handed a “diversion from prosecution” in June because of his age and all criminal proceedings were scrapped.

The boy, from Ayrshire, had been charged with rape but only hours before he was due in the dock, prosecutors agreed to halt court proceedings.

He had been due to take up a football scholarship in the US and as an alternative to prosecution, and without admitting any crime, he was offered and agreed to do a six-week social work course.

I note the massively misogynistic difference between the way society is treating this alleged rapist and the way it's treating the young woman who was raped. Does she get a course to help her deal with her trauma? I fucking doubt it, she's not even entitled to single sex rape support according to Edinburgh Rape Crisis Centre.

Hard to get a US visa with a conviction so justice system preferred to value the scholarship over a girl being violated. Says it all really 😡

From that previous thread, it seems the US did deny him a visa so at least he won’t have been able to take up the soccer scholarship. hardly “justice”, though.

It also seems unfair - to put it mildly - that the Scottish courts acted to try and enable an alleged rapist taking a sports scholarship place from someone else who hadn't committed any crimes. Not to mention, aiding and abetting in putting young women at that university in harms way (potentially) by suppressing a crime and allowing an alleged rapist to move through the world without a conviction just because he's Scottish and lives in AfghanisScotland - where women and girls don't have equal human rights.

Good for the US for denying the visa.

Glad to hear the Football offer fell through.

Although in relation to the experience of the woman concerned this will be the least of her worries.

I just dont understand this. Was talking to a slightly more elderly than me relative about this men up to 25 are too immature or whatever the wording was, and she thought I was joking.

She just couldn't believe it.

At this point I honestly don't understand why women in Scotland aren't revolting with actual pitchforks in hand.

WTF is wrong with that sick mess of a government? They hold women in absolute contempt and don't even attempt to hide it.

so lets see if I have this right. Rapey poor lambs under 25 don't know what they are doing so get a free pass, but 4 year old kids are clued up enough to change gender?

The US Immigration Services ask about arrests, not just convictions. What a tiny crumb to receive, being glad that he didn't get a scholarship. I hope no British place will give him one, either.

What a farce and a travesty of justice.
