I wonder what has happened to the colleagues in the light of this decision.

Will they be eligible for apologies and claims for unfair suspension? I know that ET actions need to be started within a set time-frame but would waiting on the outcome of Meade's ET seem reasonable?

Dunno but if they do sue count me in for the crowdfunders.

I can see how it happens - after all you're supposed to report abuse by a colleague, and just one client could complain about abuse and that could be valid.

But this was nothing to do with a client. Nor any other unprofessional behaviour that urgently needed to be reported. It was just a political disagreement. Reporting someone for their political views? Ew.

DrBlackbird · 10/01/2024 11:31

Slight derail… interesting that this URL comes up as the first link to a query on Maya Forstater. Why is she an ‘anti-trans’ activist rather than a pro-women feminist? Anyone know of the hiyamaya website? And it’d be great if the label gender critical could be dropped for pro-women.

In fact, I really want to force all the decision makers in all these cases onto a workshop a bit like the one you have to do when you've been caught speeding, but for respecting alternative opinions.

GailBlancheViola · 10/01/2024 11:33

one protected characteristic is no more important than another,

This needs to be hammered home and into the heads of everyone in organisations. Gender Reassignment is NOT the only nor is it the top trump protected characteristic that all others must bow down to.

TRAs and organisations influenced by them need to accept that other people have rights too, there are not and should never be any sacred castes.

Ereshkigalangcleg · 10/01/2024 11:33

Hiyamaya was the name of Maya's personal website, but I don't know if that's the correct one and TRAs have changed the title, or if it's a fake one with a different domain ending. I'd advise caution!

RethinkingLife · 10/01/2024 11:34

But this was nothing to do with a client. Nor any other unprofessional behaviour that urgently needed to be reported. It was just a political disagreement. Reporting someone for their political views? Ew.

But thought-leaders like Garden Court Chambers do it. Anyone who attended the live Allison Bailey ET hearings will have seen the facial expressions and vocalised disdain of AB's colleagues when talking about her (amidst Friday afternoons, long documents, present-buying and driving into bins).

Some time later, when CGD (Centre for Global Development) were attempting to justify not offering Maya a post, they were pretty much resorting to this. Especially the Prime Mover Ellen aka Macavity who wasn't there at the hearings but had been everywhere. Trying to think who the report writers were who were dismayed to discover just how knowledgeable Maya was about the issues. The way you would be when you appoint or involve Fellows in thinktanks - you would be startled to discover a capacity for independent thought, considered positions, and intellectual rigour.

GailBlancheViola · 10/01/2024 11:36

The Stasi behaviour of TRAs and their acolytes needs to have repercussions now, it has gone on for far, far too long.

RethinkingLife · 10/01/2024 11:36

Why is she an ‘anti-trans’ activist rather than a pro-women feminist?

Because wikipaedia, like Reddit and so many other platforms, is dominated by editors with a particular PoV.

YouJustDoYou · 10/01/2024 11:40

I still can't believe they're still calling the fact you cannot change sex a "belief".

SinnerBoy · 10/01/2024 11:47

Doesn't even Wikipedia say to take Wikipedia with a large pinch of salt?

On Stonewall and legal advice, if they have used fully qualified lawyers to push their rubbish, then surely they have some sort of liability?

In my industry, (geological and hydrographic survey) all reports have a disclaimer that, whilst everything has been done by jolly clever, highly trained monkeys, if your oil rig sinks, its not our fault, on the grounds that all data is acquired via remote sensors and processed by humans, which may give duff results.

You really, really have to fuck things up, before a client will sue, even if it's lost them a few million.

WarriorN · 10/01/2024 11:52

On Wikipedia, jfc you should see what "rationalwiki" has to say about "terfs...."

WarriorN · 10/01/2024 11:53

Claims to be centre left and is American, so I'm sure you can imagine.

Ereshkigalangcleg · 10/01/2024 11:54

They need a "this is for entertainment only" disclaimer

As the Righteous love to say, "language evolves" - but it's not just "woman" that has changed meaning, so have other words like "rational," "diversity," "progressive," "inclusive," "kind," "literal violence" etc (funnily enough, they're not so keen to trumpet the latter changes, those ones they want you to think still mean what they used to).

The group exercises in this workshop would involve them all writing "I should stop listening to Stonewall" multiple times on post-it notes

It is eventually going to have to involve support from Prevent and work related to deprogramming.

When the inevitable inquiry finally happens. Everyone who has been through the training will have to be regarded as potentially compromised, and every policy or document written by those compromised will have to be reviewed if not binned and re written.

It's an epic safeguarding disaster. And the blueprint is now there for any political extremist group that want to take over.

https://thecritic.co.uk/the-right-to-be-gender-critical/

Michael Foran’s article about this in the Critic discusses the holding and manifestation of a belief.

He's so great at exapliming the key details.

As he says, this in tbe judgment...:

We consider it wholly inappropriate that an individual such as the Claimant espousing one side of the debate should be labelled discriminatory, transphobic and to pose a potential risk to vulnerable service users. That in effect equates her views as being equivalent to an employee/social worker espousing racially discriminatory or homophobic views. The opinions expressed by the Claimant could not sensibly be viewed as being transphobic when properly considered in their full context from an objective perspective, but rather her expressing an opinion contrary to the interpretation of legislation, or perhaps more accurately the amendment to existing legislation, advocated for by trans lobbying groups to include, but not limited to, Stonewall.

Is really important for all workers who are critical of this ideology and the damage it does to women and children.

WarriorN · 10/01/2024 12:07

The de programming is going to have to be huge.

I was v encouraged by a discussion in a well known podcast facegroup recently - mainly that the owners of the podcast allowed a range of comments to stand and refused to delete comments that would probably go 'poof' here. But then there was a #bekind trans celebratory post which had 100s of likes, and many of those women are professionals.

I recognised a couple as psychologists who were acquaintances. That may be that people didn't feel they could like or comment on the other posts, but at the same time, it's clear there are a great deal of professionals at high levels who truly believe and cannot understand the opposite argument at all. That "This is a Tory right wing idea, get Labour in and all will be ok." Of course, some have their own trans family members, and that's going to be very hard indeed.

Signalbox · 10/01/2024 12:14

AmaryllisNightAndDay · 10/01/2024 11:00

Even more scary bit "Two of her colleagues were also suspended for failing to report her “discriminatory posts

Does that mean there will be two more employment tribunals related to this? Or perhaps those individual’s lawyers will be waiting to see the outcome of this and then be in an excellent position for negotiation. WCC have really shot themselves in both feet with this haven’t they?

Froodwithatowel · 10/01/2024 12:31

I found this week's polite letter to the WHO (not the band, who were much more fun) from Reem Asalem interesting in the repeated mention of 'conflict of interest'. It need repeating and enforcing. Certainly we could not at this point have a leader for example of a political party that had such a conflict of interest going on for them.

SinnerBoy · 10/01/2024 12:40

WarriorN

I've not heard of Rationalwiki before, so I looked up TERF and found the following:

A trans-exclusionary radical feminist (TERF; alternatively trans-exclusionary reactionary feminist, also trans women exclusionary feminist or TWEF)[note 1] is a member of a fringe but sadly loud and vocal hate movement within feminism, in which the vast majority of members never actually advocate for women's rights but instead, obsessively promote transphobia, especially transmisogyny, often through a range of conspiracy theories and denialism,[note 2] in addition to hostility to the third wave of feminism, while falsely claiming this is all for the benefit of cisgender women.

Well, that's it! You're all dead to me.

Swishy flounce....

The label anti-trans activist didn’t come up as a header for Wikipedia though. It came up as header for hiyamaya. Just wondered if that’s how she described herself if it’s her website? Seems a bit odd if so.

Could Rachel sue SWE for harassment?

The Tribunal concluded that the disciplinary process Rachel was subject to constituted harassment.

Thats what she has done by taking it to a tribunal

Okay thanks. My misunderstanding of the employment tribunal process. Thought it was more an exoneration thing. Hopefully the reparations are considerable and more than lost salary.
