Thank you for posting.
I have found him very informative and helpful in the past but on this occasion, he's simply reading sections of the guidance without any added insight. On a plus note, it does demonstrate how simple and clear the guidance is.

Michael Foran has offered some additional thoughts in relation to the legal advice that the government received prior to releasing the guidance:

But again, in general it seems like lawyers that are commenting on it are happy that it's robust.

Messages are, on the whole v positive about the guidance. Few TRA complaints are being robustly challenged. It all sounds a bit like the public has got its voice back on this subject. I hope this continues

It's interesting that there seems to be little evidence of effective legal challenge to this - other than the issue Michael Foran raises about compelled speech.
There are of a number of self interested groups / individuals very cross about the open rolling back of their ability to invade single sex spaces & promote parental alienation. It'll be fascinating to see how they manage to argue this without openly promoting the same arguments that predators use.

Ha ha! Yes indeed @MrsOvertonsWindow

Please complete the following sentences when replying to the consultation:

  1. A boy who identifes as a girl needs to access girls' toilets and changing rooms, rather than a private individual facility, because...

  2. Parents in families with no history of safeguarding concern should not be told if their children make a request which may impact their mental and physical health because...

I thought it was helpful that BBB compared it with The Highway Code, making the point that although it was non-statutory guidance that, like the Highway Code, instances of “must”, rather than “should”, refer to aspects that are legally binding.

However, I didn’t spot any instances of “must” as he read excerpts - I’ll have to download it and do a word search for “must” because all the “shoulds” were a mite deflating.

Rightsraptor · 26/12/2023 09:01

I'm sure BBB said 'must' when talking about single sex changing rooms & toilets etc.
