I think it's clear from the quotations, presumably from the little girl's statement, that when she accepted the lift she thought the person was a woman.

The poor little girl at the centre of this. She was incredible with her escape plan, after everything that had gone on she had the clarity of mind to carry out the plan.

Well it seems that they have 'correctly gendered' Miller as he has asked to be called he in court.

If he asked to be she then the BBC would have called him a transwoman.

Seems like sex offenders get to pick their gender to suit them.

No doubt when he is released from prison he will change his identity again back to woman and will be able to accuse anyone who refers to his past crimes of deadnaming and being bigots.

Perhaps his gender confusion will be a mitigating factor and he'll stay out of jail? A politically expedient outcome too, perhaps, to avoid any stoking of the row about men in women's prisons?

I truly hope my cynicism is misplaced and we can actually have faith in the justice system.

I think those saying that the BBC reporting him as a man shows the tide is turning are optimistic. They're reporting him as a man because he did something wrong. If he was in the news for a different reason, they'd be treating him as a woman.

It's a variant of the No True Scotsman fallacy. If he's a rapist then he's not a True and Valid transperson but only a man pretending to be trans. (Which is to say they are thinking of him as someone who only pretends to pretend to be a woman, rather than legitimately pretends to be a woman).

@Tallisker unfortunately it’s not true that the fact of his offence can never be erased - being trans is a massive loophole in past names not being searchable for privacy reasons. Lots of women have been flagging the safeguarding issues with this. A cynic might say that he doesn’t want his crime associated with his female persona so he can carry on offending when released.
