Judgement in Mermaids v Charity Commission tribunal expected in days

This is the case where Mermaids challenged the Charity Commission's decision to give charitable status to the LGBA.

Don't have any more detail at the moment, but thought you'd all be interested. It's been a four month wait already.

DH asks that if the LGBA charity status is legal and fine, does this mean that you can't call it a hate group anymore and that in doing so you would be being homophobic? And further to that anyone who harasses a member purely for being a member of the LGBA could consistute a hate crime in its own right?

The point being that Mermaids action has the unintended legal effect of legitimising the LGBA.

Yes I think ACE etc don't have much of a leg to stand on legally in future if people complain about a registered charity for gay and bisexual people being platformed. Lots of organisations/people have hidden behind this legal challenge, perhaps thinking that the charity status would be removed.

The Charity Commission statement reads like 'pack it in, or we'll bang your heads together'
Much like my mother used to threaten me and my brother when we were bashing lumps out of each other.

(It was always his fault - he was Mermaids in this scenario!)

Is it just my reading of this but this seems aimed far more at one party than the other here.....

The statements out out by both charities already differ in their tone I think.

LGB Alliance’s solicitor is Peter Daly, a partner at Doyle Clayton.

He continues to be extremely impressive in these cases.

Barring Mermaids appealing, is this the end of it? Will there be anything about costs?

....damned lies from MM including, but but limited to, they say they're concentrating on their victims users while still considering an appeal.

Also, talking of 'crowdfunding' like it's magic money that comes from nowhere and couldn't possibly have been used more productively. LGBA acknowledges who and where that money has come from, and what it costs.

A Charity Commission spokesperson said:“We welcome this judgment. As the judges confirm, it is not the Charity Commission’s role to regulate public debate on sensitive issues on which there are deeply held, sincere beliefs on all sides. Our role is to apply the law, and we consider that we did so in registering LGB Alliance as a charity.
“All charities, ultimately, must deliver on their purposes for the public benefit. We understand both charities hold opposing views, but when engaging in public debate and campaigning, they should do so with respect and tolerance. Demonising and undermining those who think differently is not acceptable behaviour from any charity on our register.”

So Mermaids thought they would lose on the issue of "standing" but went ahead anyway i.e they thought they may not even get past the first post but chose to waste a large amount of money.
And saying one if the judges was with them therefore they won is like a guilty person saying they're innocent because a jury returned a majority rather than unanimous verdict.

I'll always remain puzzled that as the court cases roll in, in favour of common sense and fairness, that the political parties are frozen in fear of the TQ+ lobby, and won't man up (sorry for genderised stereotypes, lol) to declare they'll also realign with common sense.

The Cass Report, the IOC and British Cycling rulings on female categories and EHRC guidance on sex>gender, the recent court cases incl Alison, but especially Maya, and now this, the revelations of GI in schools RSE teaching.

I understand things a lot more clearly from Helen Joyce in her recent discussion with Peter Boghossian, how societal elites have been so easily captured.

But if you were the leader of a party with any doubts, looking for a way to row back to a semblance of reality and fairness, to reconnect with 51% of the population, and a fair number of the other 49% (incl me), surely this consistency in legal results in favour of sex class based reality over trans subjectivist fantasy, would be your golden ticket, your crutch to pivot back to sunlight.

I guarantee you Sunak, Starmer, Davey et al, will all prefer to stay in the gloom and complain the light is too low to see clearly.

Demonising for those who think differently could include people who dislike Mermaids.

HOWEVER if Mermaids are under investigation for conduct and various safeguarding failures thats about conduct not what they believe.

I think it IS wise to be mindful of the difference.

Wasn't this legal action originally supposed to be brought by Stonewall as the lead but they got cold feet and dropped it all on Mermaids?

Have I remembered this right because it never made sense Mermaids bringing it? LGBA are a Stonewall equivalent in terms of category.

I don't feel in the slightest bit sorry for them but I wouldn't be surprised if Mermaids have been used here by the bigger boys.

Indeed. As a registered charity, I am surprised that this expenditure was considered consistent with their stated charitable aims. Perhaps one of their donors will complain to the Charity Commission? 😁

"Notwithstanding significant time being spent on deliberation in trying to do so, the two members of the panel hearing this appeal have been unable to reach agreement on whether, if Mermaids does have standing, LGBA is a charity within the meaning of the 2011 Act. While a mechanism does exist to resolve a situation where a panel is not unanimous1, it concerns the actual decision to be made by the Tribunal. We are unanimous that this appeal should be dismissed on the issue of standing in any event. In those circumstances we consider it inappropriate to set out our individual reasons on a hypothetical issue."
