European Court of HR upholds biological registration of parents

Similar to the Freddie McConnell case in the UK, the ECHR has declined to overturn Germany refusing a TW’s request to be registered as their child’s mother rather than father.

It appears that facts do matter after all.

Great news, thanks for posting

Thank you for sharing that. It seems to be all moving to a sensible level of supporting and welcoming TQ+ people, but the limit of transition needing to be other people's right to not have their reality controlled or re defined.

I wish there was less worry about 'outing', what is wrong with being TQ+? Be TQ+ and proud, what does it matter that other people know? Again it's the limit of honesty and reality with others.

Yes, ‘be yourself’ but lying is a contradiction in terms. But that why the whole gender identity idea is a confused illusion.

Requiring other people to lie is also entirely wrong. This was said by Baroness Caithan in the HoL when the GRA was being devised.

All children have a moral right to know their birth origins so this should never be allowed.

Clymene · 05/04/2023 18:53

This is very good news.

I'm not sure I'd trust anything McConnell says. There was a crowdfunder for their trip to Sweden to give birth to the second child but that never happened. Although the crowdfunder raised a lot less than the £10k it was asking for, to my knowledge, none of that money has been refunded

which has come to pass as predicted.

That’s good to hear!

Not entirely surprising as lots of the member countries are now far more socially conservative than the UK & Germany but you never know how clown-worldy things might get.

Freddy has been working with orgs that are mostly about commercial surrogacy, so I expect this is going to rather piss off a bunch of people who were aiming to have non- gender transitioned men registered as a child’s mother, pretend that pesky birthing body didn’t exist at all!

JellySaurus · 06/04/2023 00:47

Hang on a sec, wasn't it the ECHR that forced us to allow people to falsify their birth records in the first place?

To establish the idea of 'legal sex' as opposed to actual sex, yes I believe you're right. All to allow transsexuals (I think that was the term used at the time) to marry people of the same sex. Instead of just, you know, allowing same sex marriage for everyone Hmm

EmotionalSupportHyena · 06/04/2023 02:11

Transactivists made a few attempts at the ECHR before they got a case to stick, the one that finally worked was really decided around the right to marry (the ruling seems convinced that in doing this for an individual there will be no knock on societal effect 🤦‍♀️) and the subsequent legal sex change was a UK gov fudge to avoid same sex marriage (which ironically then caused an issue for heterosexual male transitioners who had a choice between getting a new GRC or staying married to their wives. The crack at that failed the ECHR twice)

Presumably the 1998 court assumed that as the only trans people who could get now married were the ones in same sex relationships, so the whole claiming-to-birth-out-the-baby-you-actually-fathered would never occur (and fathers on certs have never really had to be biological fathers, just men willing to take legal paternal responsibility either via marrying the mother or being present at the registrar’s office)?

Here’s a summary of all the ECHR cases that led to the GRA and the trans related cases they have heard since (not quite up to date):

https://www.echr.coe.int/documents/fs_gender_identity_eng.pdf

The XYZ case was Stephen Whittle and girlfriend (now wife of many years) and the first baby she had via donor sperm (S’Whittle has spoken about this publicly since so I’m not sharing any private info, MNHQ!)
