Victim Support Hate Crime Toolkit

Victim Support in conjunction with Police Scotland yesterday launched a new hate crime toolkit. Guess which of the hate crime protected characteristics (which differ from the equality act) is mentioned on their opening page?

victimsupport.scot/about-us/news-list/hate-crime-toolkit/

No mention of freedom of expression under ‘hate incidents’

And refers you to, amongst others Mermaids and LBGTYouth Scotland - two organisations currently under investigation for lack of safeguarding. (I also notice domestic abuse helplines though of course beating up women isn’t a hate crime).

why do the hate crime protected characteristics differ from the equality act
David 16:47
Hi, thanks for asking. I'm looking to find the Scottish Government's policy briefing on this.
David 16:48
Victim Support Scotland is an independent charity, so while we lobby on behalf of victims of crime, we were not involved in drafting this particular legislation. Please bear with me while I search for this.
David 16:52
Under section 12 of the Hate Crime and Public Order (Scotland) Act 2021, the Scottish Ministers have the power to add sex to the list of characteristics protected under that Act. No rationale is provided in the Explanatory Notes for the Act that explains why this wasn't done as part of the Act it self.

Thank you
David 16:53
There is also a Policy Memorandum from when the bill was introduced, which I have yet to have the chance to look through - www.parliament.scot/-/media/files/legislation/bills/current-bills/hate-crime-and-public-order-scotland-bill/introduced/policy-memorandum-hate-crime-and-public-order-scotland-bill.pdf

Thanks I'll have a read

God there's 78 pages to that pdf from the helpful David.

Can you ask David why he has just quoted a piece of legislation that has not yet been enacted?

“Any crime which is perceived by the victim, or any other person, to be motivated (wholly or partly) by malice
and ill-will towards a social group.”
So if transgender person feels that a person who believes that sex is immutable, which is an belief worthy of respect in a democratic society, is misgendering them is that a hate crime?
David 17:03
I am familiar with the judgment in Maya Forstater v CGD, when the Employment Appeal Tribunal held that gender-critical beliefs are worthy of respect in a democratic society.
Visitor 17:05
But would it be a hate crime if a trans person says they have been purposefully misgendered. As surely that is two different belief systems butting heads, both of which are worthy of respect.
David 17:07
Before the Hate Crime and Public Order Act, Scots law already had an offence of Harrassment - www.legislation.gov.uk/asp/2010/13/section/39
Visitor 17:08
But one person's harrassment may be another person's belief. Can a woman be prosecuted for misgendering a trans person under this hate crime legislation?
David 17:11
The only offence created by the Hate Crime and Public Order (Scotland) Act is that of stirring up hatred, under section 4 - www.legislation.gov.uk/asp/2021/14/section/4/enacted
Visitor 17:12
So if i think someone is a man I can say they are a man or not?
Read
David 17:14
It is a defence for a person charged with an offence under this section to show that the behaviour or the communication of the material was, in the particular circumstances, reasonable.
Visitor 17:15
OK. Thank you for your time.

Which bit hasn't been enacted?

Shelefttheweb · 24/02/2023 17:35

Sorry, commencement seems to be the proper term. No commencement date has been set as far as I can see.

However, I did find this: www.copfs.gov.uk/media/d3jnt5t2/hate-crime-2021-22-publication-final.pdf

What happened to a hate crime being an ACTUAL crime committed with hateful intent?

Claiming that 'mis gendering' or correctly sexing someone is a crime is nothing more than forced compliance to someone else's religion.

Shelefttheweb · 24/02/2023 18:06

Blasphemy

Just need to look at how blasphemy laws are misused 5he Pakistan against Christians to see where this can go.

Having heard today, from two women on KJK's livestream, of their reporting to the police several racial hate offenses (phone evidence) with death threats, and directly reporting to the policeman not dealing with it that they felt the actions activist who had just assaulted them had been motivated by their sexuality. Hate incident, remember? Nothing more needed than that someone felt and said to police they thought it was offensive.

Race AND homosexuality. Both reported to the police. Both ignored, shrugged over, not recorded.

This is not a hate crime tool kit, this is a police political gender ideology bias enforcement against women toolkit. Police police by consent. Mine is gone. I am not fucking paying taxes for this.
