They could be recorded as female crimes, but he wasn't claiming to be a woman when the crimes were, allegedly, committed. But the mantra is a tw has always been a woman. So, it's a pickle.

How would they record the sex of a perpetrator if he or she was claiming to be nonbinary? If they default to their actual sex, then it makes a nonsense of recording crimes by tw as a women's crimes.

I hope the judge picked up on the fact they stated they'd had consenting sex with a woman, and they said they only sleep with men.
