Nightmare proposed trans policy at work

Work are consulting on a new trans and non-binary support policy. Policy states that trans people have the right to use whichever toilets and changing rooms they like and that anyone objecting should be educated and offered to use different facilities if they still object. When I queried it I was told that the Landrover case confirmed this as law.

Pointed out that this discriminated against women of some religions, victims of VAWG etc but they’re holding firm.

Can anyone give me info/links to refute this?

They also want a category of special leave without limits for trans people.

We are a National non-unionised company.

I would pass this to Sex Matters and the EHRC at this point.

Ask them, what are you supposed to do now?

And then ask your MP, do I have equality of rights in law in the UK or not?

*They’ve doubled down. Added lines about Equality Act entitlements to use single sex facilities if you’re trans/non-binary. And put it out for wider consultation.

They’ve answered my safeguarding concerns by pointing to the policy that lets trans children sleep in accommodation with whichever* sex they like.

I agree with nilsmouse and based on the above, I would escalate to your MP at least. Child safety is at risk.

Safe Schools Alliance or Transgender Trend might be other options.

Is this their own policy, or from a different organisation?

I think their response shows that we are still unfortunately at the stage where it's best not to point directly to sex matters & similar orgs if possible, but mine their info for other resources. I know that's a bit unfair on them but I think that's where we are with orgs who are fully paid up members of the black-and-white-thinking club.

The liberal democrats had a trans policy & definition of transphobia. A group of lib dems bought a legal opinion by a specialist KC which said the policy was unlawful and opened them up to the risk of legal action. The party then bought its own independent opinion by a different kc which I presume they hoped would say the first one was wrong. It didn't. It went even further than the first one. They had to change the policy. It wasn't about loos & leave and things but I think the same principle applies. If an alternative legal opinion could be sought it would at least show the legal department they are on a sticky wicket. I don't know if that's feasible, possible, desirable. Certainly very difficult to do as an employee.

I don’t know whether to watch and wait for something to happen or to leave. :(
If you are thinking of leaving then make sure that you get them to put this stuff in writing. Makes it easier to sue them.

Is your place of work something involving children OP?

Birdsweepsin · 07/12/2022 20:40

Ask them how they feel about doing a staff fundraiser for Mermaids....

Adults and children, yes.
