I know there's been institutional capture, but legally we don't have self ID, right?
(Putting aside GRCs and the fact that a legal fiction doesn't make something true.)

Self ID is not law in England.

RoseslnTheHospital · 26/08/2022 15:15

If by transwoman he means transwoman with a GRC, then legally they are considered as a woman, with some possible exceptions where the rights of women prevent that. Eg access to single sex spaces where there is a specific need for single sex spaces. Imo, and iamnal.

tobee · 26/08/2022 15:17

Twitter replies agree Bienkov is wrong; Sunak & Truss are correct. In this instance.

If that's what he means he should be clear

RoseslnTheHospital · 26/08/2022 15:23

Yes indeed he should.

Sonia Sodha on to it here. He’s now trying to change tack having been called out.

Yes, here he accuses them of not qualifying re the GRC (despite not bothering to do that himself) before trying to conflate truth and legal fiction.
And of course refusing to just admit he was wrong, which I suppose must be hard after seeming so sure of himself.

Quite fascinating really, just how many men believe they are the ultimate expert on the nature of womenhood, even to the point of pronouncing their findings all over twitter and doubling down when women point out the bits they got wrong.
Soooooo many of them. So so many.

How does it go again? 'God, grant me the confidence of a mediocre man'.

I'm definitely writing that one down 😂

Yes, he's an idiot.

Sazzasez · 26/08/2022 17:18

He’s wrong about the law.

A GRC provides for a “legal fiction” and for people who obtain one to be protected by an “as if” - they’re to be treated as if they have changed sex.

But only for some purposes. Not all purposes - one specific exception is male primogeniture in the inheritance of peerages.

The GRC is rather muddled law - partly because an unacknowledged aim was to get round the then govt’s refusal to
legalise same sex marriage. If you get a GRC you’re treated “as if” you’re the other sex regarding marriage, but as your real sex if you’re the eldest son of a baronet.

The Equality Act 2010 clarifies that in law a woman is a female bod any age (and of course now people like India Willoughby are claiming to be “biologically female” as well as “a real woman”.

Another point is that even if the law said TWAW (it doesn’t) reality would know otherwise.

Bod??? of

RoyalCorgi · 26/08/2022 17:20

The sheer fucking stupidity of these people.

For a start, the only trans women who are women in the eyes of the law are those with a GRC. They represent a tiny portion of the whole (a few thousand at most), and even then they are not treated as women in all legislation. The Equality Act, as Sonia points out, says that single-sex spaces can legally exclude trans women.

But the vast majority of people who call themselves trans women do not have a GRC and are therefore not recognised as women in any part of the law.

Finally, even if the law said that trans women are women (which it doesn't), it still doesn't actually make them women. Everyone with a modicum of sense knows that it's not possible to change sex, and that trans women are men. Full stop.

Who is this man Adam that everyone is pussyfooting around him with such exquisite care?

Senior political editor at Business Insider. Senior editor at Byline Times.

Currently claiming that anyone who knows what the law actually says & is telling him he’s got it wrong must love the Tories...

Mollyollydolly · 26/08/2022 18:55

This is what pisses me off. I used to support Byline Times, but they spout this BS because they see everything through the lens of left and right. They are just as guilty of misinformation as the likes of Farage. It makes me so angry, you can see in his twitter discussion with Sonia that he cant see past that. He thinks agreeing with Sunak means you're a right winged tory. The lack of nuance is quite extraordinary. And the arrogance ..

inkjet · 26/08/2022 19:48

Yes I find this issue reveals so much about men people. It’s not only the misogyny and the disregard for women, but also the willingness to bend the truth or misreport what is actually happening. It just makes me think when else are you doing this? I can’t trust any of these journalists who do this. He could have just said he didn’t like the way the question is asked, or that he thinks it’s hurtful etc etc but no, it’s always present it how you want it to be and either ignore, belittle or weasel out when women protest.

Live4weekend · 26/08/2022 20:57

It's always men who claim that woman no legal right to single sex spaces.

It's almost as if they want to allow men into women's spaces.

You really have to question why. No decent man I know would want to enable a situation where woman are put in danger.
