How is it a win to have the fact that men are not women legally classified as a belief?

Love to be proven wrong but it seems like a loss to have it legally enshrined as a belief because it’s always up for challenge now

any belief can be challenged and beliefs should regularly be reviewed

but this is not a belief but a fact so I can only see it as a negative

i know I’m missing something please tell me what it is

It is both. It's simply that one of these, the belief aspect, exists in the legal framework, for equalities, in the UK. The other, the fact aspect, exists in the biological science framework worldwide. (Even though some people, including scientists, are currently favouring an anti-science denialism.)

I'm not that keen on putting facts universally agreed to be true in laws. If that were the way things were done in the UK, then we could quite easily have ended up with a law on the statute books that it's an established fact that sex is a spectrum. I'd prefer for that to be challengeable as a fact to be established in a court room based on the evidence, should the need arise.

The fact that the earth is a sphere is actually only a well supported hypothesis.

But of course, the Earth isn't a sphere, it's an oblate spheroid.

When you run your legislature to state in law the facts that "everyone is comfortable with" you end up with stuff like this:

Instead, in the UK we have a system where someone is free to declare that π=3, but the opposite side is able to provide overwhelming evidence that it's not, and it's up the science denier whether to concede the point or make even more of a fool of themselves and then lose their case.
