Another legal win thanks to feminists - an important appeal at Circuit Judge level.

Thanks to MumsNet and other feminist circles we have won our appeal on all 8 grounds - which is very unusual for a FFH.

Claire Waxman OBE, Independent Victims’ Commissioner for London, told The Independent: “This case exemplifies some of the systemic issues faced by victims of abuse when going through the family courts.

“Sadly, domestic abuse is often not identified, overlooked or misunderstood. This can lead to court decisions which are unsafe for both the survivor and their children.”
The judge failed to follow legislation including the new Domestic Abuse Act 2021.

The perpetrator was allowed to cross examine me. The judge said that the father calling me a 'bitch' 'slut' 'pig' 'lazy' etc in front of the children was not abuse but 'unpleasant behaviour'

The judge said that the father sending me threats such as 'you are playing with my feelings you won't have a happy ending' 'I won't sit here and wait' 'wait and see'.

The judge said that this wasn't abuse, it was simply 'not ideally worded'

I couldn't believe the original judgment, it was handed down in person, I sat there crying and my ex laughed, he laughed so much that the judge threatened to have him removed from court. Finally there is some justice in this appeal succeeding.

This makes me actually feel physically sick:

'a 2016 study by Women’s Aid revealed the cases of 19 children in 12 families who were all intentionally killed by a parent who was also a known perpetrator of domestic abuse. All of the perpetrators were male and fathers to the children they killed.
The perpetrators all had access to their children via formal or informal child contact arrangements – with more than half of the custody provisions having been ordered through the courts.'

The courts who had ordered child contact/custody withabusive fathers have blood on their hands. Absolutely abhorrent.

Congratulations, you bloody well deserve this. You've shown such grit and courage for your children.

I see Portsmouth City Council Social Services closed the case down and the appeal judge HHJ Levey cannot understand why. Neither can I. Except, hmmm, I don't suppose you were accused of 'weaponising your trauma' were you? There's a lot of that crap about in children's services at the moment; and of course the Family court is so secretive that it's hard to talk about it openly without getting threatened with the naughty corner.
