Gender theory in the Trial Court

And experience from Massachusetts, a lawyer describes his experiences with a course for Massachusetts judges from the Flaschner Judicial Institute:
*Supporting LGBTQ+ People in the Court System and Beyond
*

"The court also provides an interactive chart where employees can answer “Where are you on the spectrum?”:"

(When barbie and GI Joe become enshrined in law.)

He makes some excellent points;

"It should go without saying that when the court itself starts teaching the gender dogma, it sacrifices any pretense of adjudicating gender issues objectively."

"The court system has endorsed an ideology that denies that there is any meaningful difference between females and males who identify as females. Therefore, the interest of men who want to be women take priority over the interest of women."

"Inundating a child with gender options and gender ideology and asking them “Where do you fit on the gender spectrum? How do you know? Are you sure?” encourages gender dysphoria. That is horribly wrong and not in any child's “best interests.”

So it's good that he's recognised it and decided not 'to take part in the lie' but what's he doing about it? what groups are challenging it? is it left to women again? Challenges to gender dogma religion don't seem as well organised in the US, they seem piecemeal and I'm surprised in the land of the free' (my interpretation could be wrong! - could be just lack of press reporting and massive de-platforming means we don't hear about it)

This teaching would be torn to shreds by Feminist Women's groups, scientist like Dr Emma Hilton and professionals like Dr David Bell:

The court’s mandatory course teaches the following:

A person’s sex is “assigned” at birth based on physical characteristics.

A transgender person is a person whose gender identity is different from the sex assigned to that person at birth.

Gender identity is a person’s sincere belief regarding their own gender.

Gender exists on a spectrum. A person’s gender identity could be anything: male, female, a combination of male and female, non-binary, genderqueer, bi-gender, gender fluid or some other undefined category.

Identifying as transgender is not a choice. It is a biological and psychological imperative.

Employees and judges in the trial court may wear pronoun buttons indicating the way they prefer to be called (“he/him/his”, “they/them/theirs”) to be inclusive of people who are transgender and “demonstrate respect for each individual's choice of pronouns.”

The court also provides an interactive chart where employees can answer “Where are you on the spectrum?”:

Why would anyone ever need to know a judge's pronouns in a court situation? Surely it's their court and everything is directed at them?

For court employees, if you're being gender neutral you'd just say "your colleague" or "that person in the blue" (as opposed to lady or gentleman) told me x?

The fact pronouns aren't even used in these situations but are still being stated highlights the fact they're merely a political and philosophical statement of belief.

Yes very good points. The dynamic seems to be harder to challenge in the US but seems to be of utmost importance.

When twitter removes a republican (mp? Can't remember what they're called!) for pointing out that Levine was a man for how ever long (45 years? 52?) and so the appointment is a man, and destroys all hopes little girls have of breaking the glass ceiling, there's not much hope.

These training materials come from universities though don't they? My friend is a lawyer but has spent most of her career so far teaching in universities. I would imagine a university that's particularly captured would provide this gumpf.

That's a well argued piece. I hope like-minded people in the court system find him and band together

Great article. Shame it would be professional suicide to like it on LinkedIn. It is very brave of him to write it.

CharlieParley · 26/10/2021 08:44

From that link:

Gender identity is a person’s sincere belief regarding their own gender.

Gender = Sex stereotypes and sex role stereotypes or socially constructed stereotypes

Sex-stereotypes-and-sex-role-stereotypes identity is a person's sincere belief regarding their own [preferences for] sex stereotypes and sex role stereotypes.

Socially-constructed-stereotypes identity is a person's sincere belief regarding their own socially constructed stereotypes.

I really despise this kind of nonsense. Completely. It's obviously wrong of me to ask this, but if you're going to fuck up society (and judges in this case), can you please be logical and coherent? With language that isn't tautological or nebulous and without such circular definitions. I mean that's the absolute least I expect from a dehumanising, obnoxiously unscientific belief system wreaking havoc in the 21st century. (And whose believers get terribly upset if you call the doctrine of gender identity what it is - a modern day religion).

From a list of grievances by lawyers who identify as trans:

Some transgender attorneys were assumed by court staff to be defendants on prostitution charges simply due to their gender expression, specifically clothing and makeup.

^demographic survey before proceeding further. Of the twenty or so questions, a few stood out:

Do you identify [belief] as
a) Male, [biology]
b) Female, [biology]
c) Agender/ Nonbinary, *[belief]
d) Genderqueer /Gender Nonconforming, [belief]
e) Different Identity, [belief]
or f) Prefer not to answer?

Do you identify [belief] as transgender?
a) Yes, [belief]
b) No, [belief]
or
c) Prefer not to answer.

Do you identify [belief] as
a) Lesbian, gay, or homosexual, [biology]
b) Straight or heterosexual, [biology]
c) Bisexual, [biology]
d) Queer, [belief]
e) Different Identity, [belief]
f) Don't know, [biology/belief]
or g) Prefer not to answer?^

it's not surprising that personal belief and biology are mixed in the survey when the gingerbread training slide links identifying as feeling male or female with who you will have sex with.
(And what a surprise it has intersex as a third sex)

So
I was told I am male by parents
I now feel 25% like a woman/ feminine
All my social ques to other people are 100% feminine
25% of the times I feel sexual attraction it's to another man

EmbarrassingHadrosaurus · 26/10/2021 11:40

Does anyone have the feeling that the entire concept of impartiality and it's understood meaning is now being added to the list of loaded language ? There are pushes to have dictionary definitions changed in line with contemporary use of words which seems reasonable. However, some of these pushes are based on persuading media organisations to alter their style guides (looking at the BBC and the definition of same-sex attracted has become same gender attracted) and using those style guides as sufficient proof of the need to 'update' the dictionaries.

Lifton on Loaded Language and Sacred Science as criteria for Thought Reform (all 8 criteria listed in linked thread: research based on closed communities, prisoners of war etc.):

Sacred Science. The group's doctrine or ideology is considered to be the ultimate Truth, beyond all questioning or dispute. Truth is not to be found outside the group. The leader, as the spokesperson for God or all humanity, is likewise above criticism.

Loading the Language. The group interprets or uses words and phrases in new ways so that often the outside world does not understand. This jargon consists of thought-terminating clichés, which serve to alter members' thought processes to conform to the group's way of thinking.

"Your honour".

It's utterly bizarre to see the conventions of food labelling applied to humans.

Peanut butter* Contains nuts

Tuna salad* Contains fish

EmbarrassingHadrosaurus · 27/10/2021 11:53

There is a serious problem in the court system, but it is not with the interactions between court staff and transgendered people. The problem is that the court has adopted an ideology which casts doubt on its impartiality, harms women and children, and runs contrary to truth.

It's disturbing to see this play out in legal systems in so many nations.

NewlyGranny · 27/10/2021 20:30

But, Hadrosaurus, you must remember peanuts are only identifying as nuts; they're actually legumes. Like tomatoes and cucumbers identifying as veg when (whisper it) they're biologically fruits!

Wasn't there some sort of creature that got itself identified as fish so medieval believers could eat it on a Friday, too?

It's all a polite fiction we go along with because it's not worth the argument - or it was until it turned and swallowed us up.
