They're not "rewriting them", but they haven't been clear that the 5 relate only to hate crimes and non-crime hate incidents.

I don't agree with it but only the second set are relevant for the hate aspect to be applied legally.

No sorry they are right (sadly), they are not referring to the Equality Act but to the Crime & Disorder Act 1998, which lists those 5 Characteristics.
This is what people call the 'hate crimes' legislation, and note that it does NOT include sex as a basis for hate.

It is (apparently, I have no legal training) only applicable when a crime has been committed AND it is believed to be motivated by hostility or prejudice.

The problem is that the police call them 'protected characteristics' which muddies the water between this and the EA. What they should be saying is strands or characteristics monitored for hate crime purposes

Just a thought. Hate crime states religion or belief - so post Maya, are all we Gender Criticals covered? Can we report all the Terf slurs etc?

Was just about to say that. Why is this not implemented? When someone can threaten to post a pipe bomb to JKR, where is the consistency in police protection?

The two lists of characteristics are correct.

The first one is the list of characteristics under civil law. The police are an employer and must follow the Equality Act as part of their employment practice.

The second list relates to 'hate crime' which comes under criminal law. It's an entirely separate list of characteristics. The ones shown will soon be replaced by the new Hate Crime Bill that was passed by the Scottish Parliament. It hasn't been enacted yet.

It would be clearer for them to just state that from the list of protected characteristics, it is not a hate crime to discriminate against someone because of their status vis a vis:

-Age,
-Marriage or civil partnership,
-Pregnancy and Maternity,
-Gender reassignment (not the same as a 'gender identity'), and
-Sex.

Only women will be screwed over on pregnancy and maternity, and the losers when sex discrimination rears it's head. The transgender identity also punches down on women disproportionately (some may argue the gender reassignment provision does that too).

Guess what sex is disproportionately affected by the characteristics omitted from the hate crime list? Also the sex where the dis-benefits fall on the hate crime list.

I'm sure it was a complete accident, and not by design, or illustrative of whose interests take priority.

Yes, any adherence to transgender ideology should be under religion and belief. It is certainly not material reality.
