It should be irrelevant that/if a trans woman drafted the guidance. they should be objective and stick to the law

“Would “the Rapist formally known as…..” work? ‘

Only if convicted!

Presumption of innocence and all that.....
I have received a practical suggestion via private message which may be of practical support to anyone in such a situation:

“a note to the judge referring to Part 3A and PD 3AA and asking for a ruling that she is not required to refer to the accused in any way other than as 'him', ie how she knows him. She can then explain herself in a sensitive way, and the judge has a little time to think about it instead of being put on the spot and grabbing the ETBB in a panic. ........ email the note to the court and should also take a written copy to hand in to the court usher before the hearing starts.”
That is for family court.

For criminal: www.defence-barrister.co.uk/witness-protection-and-support
She can then explain herself in a sensitive way

Oh look, women expected to behave kindly, deferently, womanly.

It should be, shouldn't it? But some would argue that McCloud has a history of prioritising trans rights above other concerns:

Re the practical advice - I believe this comes from someone in the field - it’s to do with how things are not how they should be.

@Totallyrandomname

Would “the Rapist formally known as…..” work?

Seriously though, I think it’s issues like this that don’t get properly thought through when guidance is made.

Dead naming is literal violence apparently

Its weird because if I'm called by my birth name not my married name (which I kept after the divorce) I dont cry i correct
