I’ve just read this article by Jo Bartosch linked to on another thread and thought it should have one of its own.
So many good points in it from the low conviction rate for rape and sexual assault; cultural imperialism of NGOs inserting their opinions on what is right into the legal policies of other countries; issues around re-offending and the over representation of black and working class people in prison; wider issues of anti-carceralism.

A thoroughly excellent article that leaves me wondering why on earth anyone would disagree with the points made.

Rape is always going to have low conviction rates if you want a legal system based on reasonable doubt.

Generally rape involves only 2 people, the attacker and the victim. There are generally no independent witnesses.

It is the only crime that has reasonable doubt based on consent. You cannot consent to be mugged, stabbed, burgled. But you can consent to have sex and very often attackers will claim that the victim consented and therefore there was no crime and that is very hard to disprove.

I wish I could think of a way to change the justice system to improve conviction rates, I'm really interested in whether others can think of ways that could help
