Scottish woman told would be charged for homophobic and transphobic tweets

On Wednesday April the 28th 2021 I received a call from a PC Laura Daley from police scotland requesting i attend an interview for homophobic and transphobic tweets under the milacious communications act.

I was asked to attend that coming Friday, she told me I had to attend East Kilbride police station so I could be then transported to Cathcart police station in a police car because I would have to go to a police station where there is holding cells, I would be then processed, questioned and then most likely charged.

I told her I would not be attending any interview on that day especially with it being a bank holiday weekend because my autistic twins needed me and I was scared I would be held all weekend.

To this she told me she would attend my house with social workers for my boys.

I contacted a solicitor straight away and he was unable to get PC Daley so for the first bank holiday in May I sent my disabled twins away for fear of this officer carrying out this threat.

This absolute nonsense has been hanging over my head for a month, I can barely sleep
or eat and I still don't know what the offending tweet is, my new interview has been scheduled for Thursday the 27th May, I will find out what I am supposed to have said at that point and if I will be indeed charged, again at another bank holiday, I just want to say, anyone who knows me, knows I am not homophobic or transphobic, I am a hard working mummy who would fight to the end for the safety and dignity of women and girls and for my vulnerable twinnies.

If we sit back and do nothing we will regret it for ever. For this reason I will never

  1. it's a tweet that Marion is in trouble for not 'chasing trans women and calling them men' (seriously wtf, where do they even get this stuff? Hmm )
  2. we don't even know what that tweet is

I'm glad you've screenshot it. Maybe we need to put up a fund for Marion in case she wants to pursue any libel claims. I doubt that'll be the last ridiculous claim we'll see bubble up in the next few weeks

Maybe the time is right for a campaign to encourage women to report every, single time we receive abusive communications. It’s the only way we can progress things. If the police ignore then there would be a case to make complaints against them.

We need to do something other than feel helpless, angry and afraid.

Like others I would be interested to know what was actually tweeted. Otherwise people could be contributing funds towards a case that actually they do find problematic themselves.

I'd second this. The threshold in the Malicious Communications Act is a pretty high one. It might very well be that the police and the prosecutors have all taken leave of their senses. But it might also be that she said something not very nice.

(Also these are now "active proceedings" under the Contempt of Court Act 1981. People ought to be careful about posting anything that presupposes she's either innocent or guilty.)

I'm sorry for the distress it will be causing Marion and her family - but from a "WTF?" POV it will generate a lot of column inches and attention.

I hope it all settles very quickly for Marion's sake, and I will do whatever is useful for her. The whole thing has made me very angry indeed.

But, we have two or three dead women a week, murdered by men. We don't even count older women who are victims of male violence.

So, a potentially not very nice tweet getting police time over the examples earlier in the thread of men threatening women...well, it' shard not to look at this is misogyny.

The threshold in the Malicious Communications Act is a pretty high one.

Kate Scottow was prosecuted under this for calling someone a "pig in a wig" and misgendering someone.

Not saying Marion hasn't done something worse, as you say we don't know, but it's not necessarily guaranteed.

The idea that Marion has been chasing trans women conjures up images of Benny Hill in his heyday. It's quite extraordinary the way that TRAs just make shit up and apparently never have to answer for the consequences.

Exactly, I can't see why they wouldn't have told her already. I think the charge sheet, or whatever is the equivalent in Scotland, would have to give proper details of the offence.
