On Wednesday April the 28th 2021 I received a call from a PC Laura Daley from police scotland requesting i attend an interview for homophobic and transphobic tweets under the milacious communications act.

I was asked to attend that coming Friday, she told me I had to attend East Kilbride police station so I could be then transported to Cathcart police station in a police car because I would have to go to a police station where there is holding cells, I would be then processed, questioned and then most likely charged.

I told her I would not be attending any interview on that day especially with it being a bank holiday weekend because my autistic twins needed me and I was scared I would be held all weekend.

To this she told me she would attend my house with social workers for my boys.

I contacted a solicitor straight away and he was unable to get PC Daley so for the first bank holiday in May I sent my disabled twins away for fear of this officer carrying out this threat.

This absolute nonsense has been hanging over my head for a month, I can barely sleep
or eat and I still don't know what the offending tweet is, my new interview has been scheduled for Thursday the 27th May, I will find out what I am supposed to have said at that point and if I will be indeed charged, again at another bank holiday, I just want to say, anyone who knows me, knows I am not homophobic or transphobic, I am a hard working mummy who would fight to the end for the safety and dignity of women and girls and for my vulnerable twinnies.

If we sit back and do nothing we will regret it for ever. For this reason I will never

I'm wondering if the mention of "custody suite" is an attempt to intimidate and frighten Marion even further. I don't understand why they might need to keep her in a cell for an interview that's arranged by appointment. Unlike Kate Scottow, Marion hasn't been arrested so surely they just need an interview room available at the appointment time?
When a person is detained under s14, they require to be taken to the custody charging area and read their rights. Anything could cause a delay to that, and once detained, they require to be kept in 'custody.' If there isn't a room available, then they may need to wait in a cell or detention room.

Police Scotland want to speak to her regarding now-deleted alleged homophobic and transphobic content she has posted on Twitter. She is declining to share specifically what she has posted.

Homophobia and Transphobia are now hate crimes the police do have powers to tackle.

The Police have not told her what the problem is, no.

It's very unsurprising that they are keeping her hanging like this, it's exactly how the 'hate crime' laws are designed to work - by intimidation, terrorising and bullying people into saying nothing on certain subjects. The 'chilling effect' in action.

Of course, women are going to be the main targets, that's also unsurprising.

Where's your source on this? Marion has repeatedly stated she's not been told what tweets she's posted that are subject to the complaints made. And here you are, not only claiming knowledge of the tweets, but that's she's deleted them as well? Presumably you've seen the now deleted tweets via screenshots if they're now deleted? Perhaps you can share the evidence you have to support your claims?

Or are you yet another one who makes claims without backing those up with anything like evidence?

MargaritaPie - if you have some evidence to support your interpretation of events then it would be a useful service to share it to clarify matters.

If, as PPs indicate, there is none, then I wonder if there's a need to reflect on whether it's appropriate to let your assertion stand as if it's a verifiable fact?

I hope the police have told her now what tweets they are going to question her about. It is very scary to think that you can be brought in for questioning because they think you could have committed a crime, and it's only explained to you in such vague terms. Not long ago she definitely said that she had not been told.

But I wonder if it is a common police practice with communications act investigations. If someone has tweeted something that potentially breaks the law, the only evidence of the crime will be the tweets themselves. The crime, and evidence against the person, are one in the same. So they won't want to disclose the evidence until they are questioning the person, to see how they respond in the moment when shown the evidence. The fact that we allow people to have their collars felt for giving opinions on twitter is the problem.

Hate crimes require a crime first before the 'hate' part comes in the sentencing where the crime was motivated by prejudice for certain groups.

The hate crime bill isn't yet in force, as far as I understand. So this is presumably under a different law. If it's under any kind of law at all.

It’s not a crime to state a fact even in Scotland! For the first time in my life I’m embarrassed to be Scottish and bloody furious about this. I am definitely going even if I have to take a couple of trains. The more of us who can be there, the better.

Please get anyone who cares about freedom of speech to sign the petition. The freedom of women and girls are under siege all over the world and the situation in Scotland is worrying, although we are very fortunate compared to other countries, but it’s important to take a stand for all our sakes.
