Judicial College Misrepresents the law re transgender people

The Equal Treatment Bench Book is published by the Judicial College as a guide for judges and others working within the courts. It contains suggestions of measures that can be taken in order to ensure that all who participate in the legal process are able to do so equitably and fairly.

A new edition of the ETBB was published earlier this year. Regrettably, it misrepresents the law on transgender people and goes so far as to imply that deadnaming and misgendering may be criminal acts.

Institutional capture runs deep within the criminal justice system and has an adverse effect at every level.

We have already seen a shift in how crime is presented by the media, this makes it even less likely that cases will be accurately reported in the press. It also sets the scene for reporting restrictions to be put in place and for cases to be heard in private.

There will now be even less transparency and accuracy.

Does it also comment on sentences - we have seen seemingly lenient sentencing on the basis of ‘they won’t survive well in jail’ or ‘they’ve had a hard time’ or ‘they’ve suffered’. This is, of course for all sentencing really...

Good luck getting it published in a left wing publication. The left has utterly let women down. Take a look at the threads about Labour, and wake up.

This matters fundamentally because it communicates a lie. It matters in court when victims and witnesses are instructed that the evidence they give must be “respectful of pronouns”. Victims of violent offences have been compelled to use female pronouns to refer to their male attackers. Males convicted of sexual offences against children have been referred to at trial as female. Where do the limits lie concerning who will be compelled to describe their male attacker as a woman?

Words are powerful, and the drip-drip effect of repeated reporting that serious violent and sexual offences have been committed by women distorts our understanding of the known differences between patterns of male and female offendingg^ . This affects our thinking about risk and safeguarding. Transparency and openness in judicial processes are important principles. It should only be in rare and carefully justified circumstances that the right to privacy requires reporting restrictions or a private hearing. Referring to biological sex, ‘misgendering’ or ‘deadnaming’ are not such circumstances.

It's important that these issues are raised.

No comment on the issue of the regulatory capture of the judiciary that works against women's interest and legal rights I see?

why is it that these women feel the need to speak out through the medium of conservative institutions that have in the past directly opposed the rights of sexual minorities, people of colour and women? surely working with, supporting and voting for those organisations would be throwing those people under the bus to torture trans people, and if so, why do so many so called feminists still go along with it?

Should I be silent unless and until a left-leaning (how left is left, BTW?) institution is willing to publish me? In this particular case, I was asked to write something and I did. I am equally happy to write articles for left-leaning publications. Last year I was asked to write something for the Centre for Crime and Justice Studies.

I should point out that 'political purity' is not how Parliament and the business of government works. That ALL PARTY Parliamentary Groups exist should be one indication of this.
