Although this article is in the Guardian, it is a press released published in a number of papers both in the UK and US. Quote:

... The Trump administration had defined “sex” to mean gender assigned at birth, thereby excluding transgender people from the law’s umbrella of protection.

... Monday’s action means that the HHS Office for Civil Rights will again investigate complaints of sex discrimination on the basis of sexual orientation and gender identity. Hospitals, clinics and other medical providers can face government sanctions for violations of the law.

www.theguardian.com/world/2021/may/10/us-bans-sex-discrimination-lgbt-healthcare

Does the US not have laws that forbid discrimination on the basis of sexual orientation or gender reassignment.

Why this need to distort what words mean.

Or is this just another example that what passes for trans rights is much more about denying that women need rights.

I can believe that grown up education people in the US dont see how mad these seems.

Apparently this definition of "sex discrimnation" to include LGB and trans goes back to Obama.

In a few years there will be so few of us left who grew up and were familiar with what the word sex actually means that I suspect in the future it will only be used in relation to "having" sex with someone.

Sad

I read that today and feel too defeated to respond well.

The best I can say is we have a patchwork of laws on discrimination.

The situation in USA is v different. I'm not an expert by any means and but USA but sure I've read that in some states (?) there is no protection for eg gay people, you can be sacked from work for being gay.

That means that there is a right for rights for various groups. The T is in with LGB and so the fight for eg employment rights is across LGBT and so anyone who is not on board with TWAW etc or saying they shouldn't be in sport according to gender not sex are seen as being against the rights for all LGBT people generally. This is where the idea comes from that people who are not on board with TWAW etc are religious/ regressive/ homophobic etc.

I think that's right anywhere.

Of course the situation in the UK is totally different. We have protection for a range of characteristics. This seems lost on people who come sometimes to tell us we're bigots etc though.

NiceGerbil · 10/05/2021 22:41

Just read the guardian piece.

I don't get it at all.

What's wrong with expanding it to discrimination on the basis of sex, sexuality or gender identity?

Saying that a person who is discriminated against because they're gay, is sex discrimination is ?????

Unless they think gender means sex and sex means having sex...?! That's all I can think of.

It's bizarre.

So they have defined sex in law to mean sexuality, and/ or internal gender identity. And presumably gender expression? Has male/ female been removed, I think it has.

So sex now in USA law explicitly is nothing to do with male/ female.

I think that's what's happened.

Not enough FFS in the world.

I appreciate there are differences in various states but the point is this is the Biden administration apparently going back to an Obama directive.

And it may as well say "people should not be discriminated against".

If there is no sex, then then there aren't any lesbians or gay men because the definition of that is same sex attracted.

And even if it was something about trying to out smart some reactionaries states then yet again women have been thrown under the bus to achieve that.

In implementing this they in fact take away protection for gay men and lesbians as much as for women, because it all comes down to identifying.

So if you are a woman identifying as a man than does that mean migosynist doesn't see that you are a woman, and goes, this is great another bro is joining the work force.

This is beyond Alice in Wonderland it just doesn't make sense. And the fact that so called politically clever people have actually thought this is something to aim for is just mindboggling.

I even went onto the guardian facebook page to see if I could comment there, but they haven't posted the link.

Is anyone in touch with Private Eye? Do they still do that Pseuds Corner?

Or maybe Glinner would like to pull this apart.

Is this what 20 centuries of so called civilisaton has achieved?

I had to stop myself ranting out loud on the bus on the way home.

I never thought I'd say it but I'm starting to think better the devil we knew!

HHS secretary, Xavier Becerra, said in a statement. “Everyone – including LGBTQ people – should be able to access healthcare, free from discrimination or interference, period.”

This should certainly be the case. Although of course healthcare should also be safe, informed by evidence and ethics.

The Trump administration had defined “sex” to mean gender assigned at birth
the Trump administration proceeded to try to narrow the legal protections against healthcare discrimination, issuing rules that narrowly defined “sex” as biological gender.
The Biden administration action essentially restores policy established during the Obama years. The Affordable Care Act included a prohibition on sex discrimination in healthcare and the Obama administration had interpreted that to apply to gay and transgender people as well. It relied on a broad understanding of sex shaped by a person’s inner sense of being male, female, neither or a combination.

US healthcare is unsafe when the reality of sex is denied.

'Gender Ideology is Wreaking Carnage in Our Medical Schools – An Eye Witness Report'
MAY 9, 2021

(extract)
"Our curriculum is constantly subject to revision. Around two-thirds of our written materials have been updated with this new language. For the one-third that has remained out-of-date, our class has received multiple apologetic, itemized emails from course instructors in which they provide corrections, beg for forgiveness and patience, and avow to “do better”. In class, we have been given multiple histories in which the patient’s sex has been deleted, even for cases involving disorders which can manifest differently between the sexes. The words “female” and “male” are being erased and replaced." (continues)

Sex discrimination on the basis of factors other than sex. WHAT.

stumbledin · 11/05/2021 14:41

And much as I know that trans activists and currying favour politicians are to blame, we all know that had the so called free press decided we are not going along with this nonsense it wouldn't have happened.

If political systems have no functioning opposition to the ruling party, we would once have thought well some journalist or reported will look into this and shed light on what is going on.

But this no longer happens. newspapers / new sites are just like the politicians playing to what they think is the most vocal reader / voter. I say most vocal as I dont think it is any way most representative.

@Delphinium20 :( no more discrimination? what will i do on my sunday afternoons now?

quixote9 · 12/05/2021 20:50

There's a biblical story about words no longer having shared meaning and people not understanding one another, right? (It's on the tip of my tongue.... Bab-something....) And that happens right before the whole place falls apart.

There's a lesson in there somewhere.
