Not many details but Sarah Phillmore has tweeted that a woman has been told to present herself to the police.

X is being told to 'present herself for interview' re a transphobic/homophobic tweet which is a 'hate crime'.
Not clear to me if she is being arrested. I assume advice would be a) refuse to go unless arrested b)offer no comment interview.

I hope that they are able to obtain advice from somebody specialised in Scots law.

It didn't take long, did it albeit I've no idea what is complained of (and I can understand that referring to/linking that tweet would be inappropriate - although, if it isn't, that is a chilling effect).

Would it be more noteworthy if a slew of women in Scotland stated a material fact about sex classes or asked the Staniland Question? Something completely reasonable such that it completely baffled the public that such might be considered an offence?

Well, yes, but for
  1. I'd be utterly terrified and
  2. I have dependents that mean I can't really BE arrested, there'd be nobody to look after them.

That's how these fucking laws are effective. Governed by fear and the worry of those we care for.

It received royal assent on Friday and "the other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint." I think that means now after the election?

Scottish Parliament site says it went into effect on 23 April (scroll down to the bottom, expand Stage 3) - www.parliament.scot/bills-and-laws/bills/hate-crime-and-public-order-scotland-bill

PigeonPants section 21 states:
21Commencement
(1)This section and sections 17 and 22 come into force on the day after Royal Assent.
(2)The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.
(3)Regulations under subsection (2) may—
(a)include transitional, transitory or saving provision,
(b)make different provision for different purposes.

So only two three sections now in force: this; 17. ancilliary provisions; and 22. short title.

Yes, agree Arabella it's how they do it. Surely this law wont hold, especially if TRA's test it and the press decide it is unfair and unjust. However, a Spartacus moment would be good.

I wonder of we could travel north and be of some help.
