@ItsAllGoingToBeFine
The main hearing is the Judicial Review they are planning for next week. If the outcome of that was different then the interim relief could be set aside. The judge was considering if there was an arguable case that the guidance was wrong which he was satisfied it was. In theory the JR could come to a different conclusion once all the arguments are heard but I would be surprised. I believe FPFW are challenging whether or not the GRC should be used as well or just birth sex.
Thank you!

I believe FPFW are challenging whether or not the GRC should be used as well or just birth sex

That would be very interesting...

nauticant · 09/03/2021 14:52

The summary by FPFW:

twitter.com/fairplaywomen/status/1369299689846226953

highame · 09/03/2021 14:52

That's my understanding RedDogs. The interim relief is because the Judge concluded that by their own guidance, the ONS acted unlawfully. Ayone?

GAHgamel · 09/03/2021 14:52

Uh-oh...
JE says they may wish to appeal interim relief and can it be listed before a divisional court. /82
Judge: Permission to appeal granted if they need it /83
Judge: resume for directions hearing by 4.30pm for a one day hearing next week. Court adjourned /84

What's a divisional court, and is that likely to make any difference?

Great work Dr nic and Co!

Unbelievable we had to go to court to decide what Sex was Hmm

Unbelievable we had to go to Court to ensure data collection was accurate and meaningful.
stuckinatrap · 09/03/2021 14:57

Whatever happens, the more court cases, questions in the Houses of Parliament and JRs where a judge says that 'because Stonewall told us to' is entirely unacceptable justification for policy, the better.

It's like when you have a spate of bad playground behaviour and every child you questions says 'X told me to do it' (X being big bully who never gets their hands dirty themselves, but manipulates all around them). It doesn't wash when you're 8 years old and in the playground and it doesn't wash in the Big Wide World either.

Let the grown ups speak.

lifeturnsonadime · 09/03/2021 14:59

This is great work because I think this was a real attempt to bring in self ID by the back door.

I hope that the full JR outcome will reflect this decision. I can't think of any other argument, not based on Stonewall guidance but on actual data, that can be brought.

Thank goodness for FPFW and all who donated to bring light to this issue.

Whatwouldscullydo · 09/03/2021 14:59

Yes red

False information doesn't benefit anyone does it. I mean why would you argue to be able to act in a way that could cause harm. Makes no sense whatsoever ever . I do have ny theories but I'll he banned fir saying so I'll just say this. Facts aren't value judgement. You cant fix problems you cant see.

ChazsBrilliantAttitude · 09/03/2021 15:00

Divisional court would be a hearing in front of two judges. It would be an appeal to have the interim relief set aside.

nauticant · 09/03/2021 15:00

One sad thing is that even if the BBC were minded to give this space on air, at the moment it would be squeezed out by the blanket obsessive coverage over Harry & Meghan.

AngelaMerkelEyeRoll · 09/03/2021 15:00

Is anyone else watching the FairCop case youtube feed? I'm struggling to work out what is going on.

I am bowled over - common sense has won!

I have never felt more proud of an organisation that I support - I already give them more than I have given any other charity - and this inspires me to go and dig deep again.

They may not be asking for more money now (I don't know whether they are) - but they certainly need it going forward. They are a small organisation doing extraordinary work - lets help them do even more!

MenopausalCrone · 09/03/2021 15:01

Proud to say I donated. What a breath of fresh air🙌

stuckinatrap · 09/03/2021 15:01

I think the most jaw-dropping moment was 'sex is an umbrella term.'

If that doesn't cause an incredible number of people pulling 'wtf?!' faces then I don't know what will.

I do so hope they use that argument again!

I couldn't agree more. I've already had an 'if I won the lottery' daydream about how much of their work I could find if I won millions.

allmywhat · 09/03/2021 15:03

Would an appeal against interim relief happen before the hearing next week?

I would really like to understand the decision making process here.

RedDogsBeg · 09/03/2021 15:03

For the 2021 Census:

Sex = sex on birth certificate or a GRC
Sex is NOT Gender identity.

Hallelujah!

The fact we had to go to Court to prove this and prove that it never was is ridiculous.

That argument about using sex segregated services on the basis of the gender you identify with, doesn't stack up does it.

LizzieSiddal · 09/03/2021 15:03

Brillaint!! Thank you so much to all those at FPFW who have brought this case.

Surely there must now be some kind of enquiry into Stonewall and the illegal advise it keeps giving out!

I tried to watch a bit of it but there's too much going on with that and the ONS. I also need the filter of mumsnet to understand a lot of it.
FindTheTruth · 09/03/2021 15:04

is there a separate thread for Glinner and Helen? starts now

I'm having difficulty with the volume on the Harry vs college of policing. I think there's a live tweet going on so will try and find

Sophoclesthefox · 09/03/2021 15:05

FedUpWithBriiiiick · 09/03/2021 15:06

Mumsnet gets a mention from Glinner!
