There needs to be an FOI now to establish who the ONS engaged with which led to the change in position because in February they were clear that the census would record legal sex. Something happened between then and now which changed that position. Secondly how much taxpayers money and civil service time will be spent to fix this.

The main hearing is the Judicial Review they are planning for next week. If the outcome of that was different then the interim relief could be set aside. The judge was considering if there was an arguable case that the guidance was wrong which he was satisfied it was. In theory the JR could come to a different conclusion once all the arguments are heard but I would be surprised. I believe FPFW are challenging whether or not the GRC should be used as well or just birth sex.

Dashing by - I can only hope the OBR has something to say about what this mess will cost whatever the outcome.

I hope for stern reprimands for the ONS changing its mind at best at such a late date - if we genuinely accept that no manipulation was intended.

I am praying for an exploration of the evidence base of the survey and who was surveyed for this late-breaking change of guidance.

Will we need to crowdfund the ONS' likely appeal to this as well as the fuller JR?

So pleased with this ruling, and coming the day after International Women's Day no less!
The fight for women's rights never ends and I'm glad to have contributed a small amount to this case and several others currently going on. Feels like the most effective use of my ££ these days!

Thanks to FPFW for bringing this case and I hope to see it widely reported, but who knows with the media at the moment.

That post on the ONS website would be rather nice coming up in court. I don't think Judges like underhand stuff too much and they have already said if anything goes against the ONS then it's their own fault

Just to make sure I understand correctly:

The Judge has awarded the interim relief and stated that the Guidance to the Census must now read Sex as on a Birth Certificate or GRC, and that must happen now.

The full Judicial Review is to prove/disprove that the ONS acted unlawfully in changing the Guidance and the terms of collecting data on the basis of sex.

Have I got that right?

Is there an opportunity now for the ONS to admit they were unlawful in changing the guidance and therefore avoid a full JR or is it now up to the Judge?
