I’ll follow with interest because I think environments like prisons really highlight the issue of trying to treat trans women exactly the same as women.

If the Act had been clearly drafted and then properly enforced those 5000 transsexuals would have caused far fewer problems than we're seeing at the moment Ereshkigalangcleg.

It was the combination of Act being inadequate, the opportunism of the non-transsexuals trans umbrella people, and this being facilitated by captured institutions, media, and key parts of the establishment that has led us to the sorry state of things today.

It's how a very biased, one interest lobby group has been enabled to write so much policy that has found its way into law. That lobby group has no experience, knowledge or interest in women, and arguably could be said to be prejudiced against women, particularly in a conflict of interest. As a result, we're now in a court room where the law is stacked against women, does not see them as equal in any way, and the prime consideration is always the wishes, needs and rights of the transwoman. We're actually arguing about how much harm justifies interrupting those wishes, needs and rights instead of regarding the equality of rights of the women in the situation, because the law was set up that way.

It just blows me away. How was this allowed to happen?! Who was asleep at the wheel?

and thus the Act was always going to cause chaos down the line.

A few people in parliament said this at the time, but they were ignored as it was only ever supposed to apply to about 5000 people of both sexes.

It’s ludicrous to think how naive politicians were and how much has changed in a few years.

It always needed to end up on the courts, the capture across the institutions is so complete.... threatened by activists right across the captured landscape. This had been just about 100% successful until the courts got involved and started to ask "what does this mean?", "how are you seeking to apply this?"

yes we need more court cases for the misinterpretation of the equalities act

Well, seems to be us - as in women - we are the ones who lose out, we are the ones who had to fight to the death for the rights we gained and we are the ones who have to protect them.

What I find unforgivable is the women in power who allowed this to happen - and as I wrote on other posts here, refuse now to acknowledge the damage they have done to women.

Probably totally unrelated, but the current Minister for Prisons (Lucy Frazer) has just been announced as taking over as Solicitor General from Michael Ellis who is taking over Attorney General while Suella Braverman is on maternity leave.

As I've said many times, in a male dominated, male focused and primarily male serving system, the women who are permitted to rise through the political ranks and speak in parliament and be ministers got there by winning the game of Patriarchy. They did not get there by making the wrong noises or going off message. The few who have managed, such as Joanna Cherry, we see how they are punished for stepping out of line. It took me well over four decades of life as a woman to realise how very serious for women it is that women have such unequal representation in power.

But more than fifteen years ago equality impact assessments were a standard thing, impartiality and professional responsibility and critical thinking of policy was a standard thing in local government and national government. There has been a massive, massive failure here and heads should roll that such prejudiced imbalanced policy ever made it into law, based on one political lobby.

KM: The minister 'cleared' the trans policy in March 2019. This was before MOJ policy makers were alerted by NW/RG to the fact that single-sex exceptions could apply in prison. /20

Redactions in ministerial statement means we don't know if minister was ever told that single sex exceptions can apply and could be an alternative policy choice /21.

Yes, but OTOH they can't hide behind the Diversity Champion scheme, because it is for employers. The MOJ can't argue that the well-being of its staff depends on women's prisons being mixed sex. Although at this point I wouldn't be surprised if they did.

policy heads and policy advisors in public institutions meet with Stonewall outside of the champion scheme all the time as 'LGBT representatives'. So.... Queer theory, parading as LGBT, is influencing policy makers. Policy makers change policy and government services and spending in line with Queer theory. Queer theory is anti women, anti children and homophobic.

What we're seeing is growing awareness in the legal establishment that the foundation of the legal recognition of gender, the Gender Recognition Act 2004, is fundamentally flawed filled with crap contradictory definitions trying to give something legal force that it should not have and thus the Act was always going to cause chaos down the line.

It didn't for maybe a decade while trans activists began to cotton on to the fact that an unprecedented land grab had opened up to them. When the chaos started to bite, a fantastically effective tactic was rolled out, anyone who said "hang on" got called a "bigot" and also was threatened by activists right across the captured landscape. This had been just about 100% successful until the courts got involved and started to ask "what does this mean?", "how are you seeking to apply this?", etc, and now a complete shitshow is being revealed.

Things started going wrong straight away.

"The claimant, in the above case, was a pre-operative, transgender male who had been convicted of manslaughter and imprisoned. 5 days after his release he committed an attempted rape. Following this offence he was returned to prison and sentenced to life imprisonment.

The prisoner had been granted a Gender Recognition Certificate (GRC) in 2006. Thus, only two years after the Gender Recognition Act (GRA)had been passed, a bodily intact, biological male, who would go on to commit attempted rape, was recognised as a “woman” for all purposes. Because of this legislation the prisoner was allowed to mount a legal challenge to his incarceration, in the male estate."
