They've just tweeted:

"BREAKING: We're pleased to announce that Fair Play For Women has instructed a barrister to evaluate the lawfulness of the ONS approach regarding the definition of sex in the Census."

"If the ONS has broken the law we will hold them to account in the high court by judicial review"

This is great news! I hope they do have a case.

Although, as an aside I'm fed up that so many brilliant women are having to spend so much time, money and effort using the courts to get people who really should know better to do the basics of their jobs properly! It appears to be the only way, though. And a very effective one at that... ideology and bullying tactics don't fare so well in a court of law.

For the census2021
Sex = sex on birth certificate or a GRC
Sex is NOT Gender identity.

(although the ONS have been given permission to appeal the interim relief)

I'm a bit dim when it comes to legal stuff, so I have a question that I think will reflect that.

If this finding is that "sex is not gender" does that mean that in English law it is reasonable to state that women and trans women are two different groups of people?

A lot of my peers insist that TWAW and so I'm hoping that I might be able to use this finding as a rebuttal.

Not quite.

People with a GRC can still say they are the sex on the GRC. What this ruling says is that it's the sex on the birth cert or GRC that must be recorded as sex. Not some vague notion of "some such" document, like a passport, or gas bill, etc, none of which need anything official for the original sex to be legally changed. So, this was self ID by stealth and that's what we're trying to stop.

Natal men with a GRC can legally say they are women.

I’ve just been reminded on twitter that only in the last few days p-news was banging on about how they had ‘joined up with the ONS’... would this bee a financial joining up? Some kind of sponsorship or advisory deal? How interesting.

This isn't about the categories man and woman as such. The census asks what is your sex? You have to choose male or female. The judge has said that's sex, and is different to self described gender in the gender id question. It doesn't address the question of whether female & woman are the same thing.

Could the interim measure of changing the guidence potentially be reversed after the full hearing if that judge has a different view? I assume so, or if wouldn't be described as interim.
