No sure much ‘wisdom’ by the court was required in arriving at that discussion. It was obvious. It’s undergraduate level stuff. I recall a case against the jockey club, considering whether it’s was a body that could be subject to JR, so this is hardly a new line for a court to consider. If I were the claimant, I’d have some serious words with their legal team about their advice to proceed to court - hope their fees were modest.
