This is excellent news. For those of you unaware, the Scottish Government legislated that there had to be equal number of men and women on boards. Of course, they defined women as including men, so For Women Scotland applied for, and have been granted, a judicial review. Piece about it here www.scottishlegal.com/article/blog-shifting-sands-on-the-definition-of-woman-in-scots-law

Spades out!

Redefining woman to include any male who decides they are a woman will strip away any protections women have under anti- sex discrimination legislation.
Vitally important judicial review.

highame · 21/10/2020 16:27

If FWS win the case, this is going to cause a real dilemma. If the Scottish Government wanted to challenge they would have to go to a higher court which would be one of the higher UK courts. Now I think Nicola Sturgeon would rather eat her own arm than have to go through a UK court.

Lots and lots of sunlight either way Grin

Bumping this as I think this Times Article shows just why this action is crucial. The SNP are determined to break the law and are quite blatant about it.

BetsyM00 · 22/10/2020 13:51

They are rather blatant about it, aren't they? This time they've not even bothered to try and change the legislation to redefine women to their liking, but have just gone ahead and done what they wanted regardless.

Sunlight and fresh air..

334bu · 22/10/2020 16:54

Shows why this judicial review is so important.

BetsyM00 · 24/10/2020 10:26

Just over the half way mark towards the target!

And here's another example of why it's so important: Incredibly a MSP was on Twitter last night calling women "bitches" for not showing respect and kindness over preferred pronoun use. The same MSP who was on the Committee that changed the definition of "woman" on the GRPBA without proper Parliamentary scrutiny or public consultation.

There is a cost to women. The Government has made it so, by weaponising pronoun use as a defining quality of what a woman is. Being "kind" could see a woman passed over for a position reserved for a member of her sex because she was kind to a colleague.

This whole mess so needs to be challenged in court.

Well they want to take our name " woman" away so they have to replace it with something and it would appear that Ms Ross has chosen that new name " bitches"

Sillydoggy · 26/10/2020 10:24

Donated, this is such an important case

littlbrowndog · 26/10/2020 10:29

I know. Bitches. From a msp

fatblackcatspaw · 26/10/2020 12:23

please dig deep

ArabellaScott · 26/10/2020 13:33

'Bitches'? That is an MSP? Really?

Sweet suffering Christ.

334bu · 27/10/2020 13:31

Bump! This is really important. If we allow the Government to change the meaning of woman then we will have no protection in law against sex discrimination.

Tbh i know there's a temptation to see Scotland as on the fringes of all this but we know that our country is being targeted, as was Ireland.
Religion and enlightenment. If they can topple us both, then everywhere falls.

have been heroic too

Kind of sums up how important this is. If one government gets to redefine what a woman is then it makes it easier to tackle the next and the next and so on.

I did a little digging today. Second trip to this particular field. We've got 15 days to go and 3,900 holes to dig. Anyone able to help with a few?

morningtoncrescent62 · 30/10/2020 21:34

Thanks for the reminder, @SciFiScream. Payday today so I've splashed out on a spade and done some digging.

Cismyfatarsey · 31/10/2020 09:38

This is getting close. Can anyone share it in wider networks to help with the last push?

334bu · 01/11/2020 21:44

Only 715 holes to go.

SciFiScream · 01/11/2020 23:21

We've done. It!! We've done it!!!

334bu · 01/11/2020 23:25

Excellent to see this into the stretch target now! Well done and thanks to all involved ThanksWine

Two government funded groups have been granted right to put a submission in at last minute, details above. This will of course involve more legal expenses for For Women Scotland.

morningtoncrescent62 · 11/12/2020 22:37

@334bu I just got the update from FWS. They say:

"A hearing was held this morning to determine whether Equality Network should be allowed to intervene in the case. Lady Wise allowed intervention of a written submission of no more than 5,000 words by 18th December - permitted on the basis it doesn’t include evidence, but quotes and ex parte statements...

Clearly this intervention will add considerably to our costs. Aidan O'Neill QC has already had to make an additional appearance in court and will now have to spend time addressing the contents of the intervention document."

Gardening at this time of year is difficult, but needs must.
