Why are the Police using categories to define 'non-crime hate incidents' that are different from the protected characteristics in the Equality Act 2010? I'm not surprised the judge chucked it straight up to the Supreme Court for a ruling.

The categories are different, afaik? 'Sex' isn't included, for a start. Because the police thought they couldn't cope with misogynistic hate crimes being reported.

Yes, sex isn't included so all the misogynistic abuse to JKR and to GC women on twitter isn't categorized as hate.

I expect some of the anti-lesbian stuff would be - maybe we should all report that to the police every time we see it.

Yes, how does it work? Who chooses? If it's not actually a crime, I mean. Who chooses what 'incidents' are legit???

The CPS and Police decided on the categories, iirc.
Look at your local council website and see what they list as 'hate crime' categories. We've had quite a few threads on this but can't find any to hand atm.
The categories and hate crime are one thing, but the non-crime (non-hate, non-evidenced) 'hate incidents' are another thing completely.

From CPS website:
In England and Wales the monitored strands of hate crime are:

racially and religiously aggravated;
homophobic, biphobic and transphobic; and 
disability hate crime.

These strands are covered by legislation (sections 28-32 of the Crime and Disorder Act 1998 and sections 145 and 146 of the Criminal Justice Act 2003) which allows prosecutors to apply for an uplift in sentence for those convicted of a hate crime.

The police and the CPS have agreed the following definition for identifying and flagging hate crimes:

"Any criminal offence which is perceived by the victim or any other person, to be motivated by hostility or prejudice, based on a person's disability or perceived disability; race or perceived race; or religion or perceived religion; or sexual orientation or perceived sexual orientation or transgender identity or perceived transgender identity."

There is no legal definition of hostility so we use the everyday understanding of the word which includes ill-will, spite, contempt, prejudice, unfriendliness, antagonism, resentment and dislike.

Who chooses what 'incidents' are legit??? it's obviously all the LBGT police groups.

Cambridgshire police.
We have liaison officers, known as 'LAGLOs', which stands for Lesbian and Gay Liaison Officers.

Our LAGLO officers work with the Lesbian, Gay, Bisexual and Transgender (LGBT) community to understand the issues they face and to ensure we hold a positive relationship.

Our LAGLOs offer information, advice and support to LGBT victims and witnesses. It’s hoped that these relationships encourage the reporting of transphobic, bi-phobic and homophobic incidents.

LAGLOs also offer advice to other police staff and officers in our force. They also support investigations to ensure members of the LGBT community receive a fair and equal service

As I often ask, where are the grown ups? This hate incident thing always strikes me as something thought up in a year 6 project to win squabbles. Open it up to include sex and please explain, whoever set it in motion, why that's not a criteria. Otherwise, I'll keep wondering about the agenda.

Just caught up properly on the thread; not only did we grow goose barnacles on the hull of our boat as we crossed the Atlantic but we used Stephen Fry's mate Mark Cawardine's book to identify the whales we saw. Some years later, I went on an orca spotting trip to Norway on which Mark Cawardine was the expert. I didn't really twig it was the same guy until we were in the whale museum gift shop & there was the same book for sale & I made a loud exclamation of realisation. With Mark standing behind me. Cringe. Great guy. We both got food poisoning from the fish soup in the hotel.

I have nothing particular to say about my labia.

I wonder if it might be arguable that the Equality Act 2010 carries a presumption that each and all of the protected characteristics must be accorded equal protection under the law? That the CPS and the Police can't pick and choose which ones they prioritise when they accost and warn people over, and record, the thing they call 'non-crime hate incidents'?

After all, if there are no crimes, then the earlier Crime and Disorder Act and the Criminal Justice Act can neither apply nor be relevant.

The poster just says I heart JKRowling FFS. JKR is one of the most widely read authors in the world. Women are no longer allowed to speak freely. I hope Posie mounts a legal challenge to this.
