I thought there was a John Cleese thread already but I can’t seem to find it. Has it been deleted?

[quote AlwaysTawnyOwl]The spouse can either agree or they get an annulment of the marriage. James Kirkups article below explains it admirably

What are the legal implications of it being annulment rather than divorce? Obviously in a divorce there is an agreement about the split of marital assets. How does this work with annulment which, my understanding is, treats the marriage as if it never existed.

Annulment has two types - marriages void from the outset (eg bigamous, under age) and marriages which are voidable (unconsummated, spouse has "sex" change).

Voidable marriages remain valid until annulled.

The court has the same powers re financial settlements (and childcare matters) in annulment as it does in divorce.
