perceived as such by victim

Oh look. It's that badly thought out, lazy wording of policy thing having the exact unintended consequences that everyone warned them about.

Again.

BoreOfWhabylon · 20/11/2019 11:57

If the judgement goes in Harry's favour, is he likely to be awarded costs? And will the complainant have to pay them?

I already posted on another thread.
could a recorded complaint like this be the reason for carol's issue with the esta?

terfsandwich · 20/11/2019 11:57

It was the transman James Morton in Scotland I think who said people should report trans hate incidents to bump statistics up.
As I recall anyway.

Datun · 20/11/2019 11:57

Now comparing transphobia to racism. And saying transphobia is different.

It would be very interesting to get an actual definition of transphobia.

Because not believing that people can change sex is not transphobic. Knowing that there are many transwomen who have a cross dressing fetish is not transphobic. Wanting to retain sex segregation is not transphobic. Etc.

FloralBunting · 20/11/2019 11:59

Judge - does it come to this. Not my job to decide for either side of this debate. but if I use derogatory racist terms, its clear. But If a say a trans woman is a man, there is objective evidence to support that view.
That is point
@Docstockk
is making - YES

Brilliant.

Nice to see the judge seems to get it?

ForeverFaff · 20/11/2019 12:00

What's chilling is that the police are using Harry's robustness as a defence! So, either you stop doing what we tell you to stop doing, or we will record it as a hate crime and you can't complain because you can't have been scared of us as you didn't stop doing the 'non-crime' we wanted you to stop doing.

FloralBunting · 20/11/2019 12:00

stripey, possibly. Not sure.

TheProdigalKittensReturn · 20/11/2019 12:00

I'm anticipating the #canceljudge campaign already!

TheProdigalKittensReturn · 20/11/2019 12:01

He's right though.

Datun · 20/11/2019 12:01

The judge does indeed get it.

terfsandwich · 20/11/2019 12:01

Wow what a savvy judge. Its nearly midnight here and I should be asleep but I am riveted!

Great live tweeting too.

Michelleoftheresistance · 20/11/2019 12:07

The right to speak the objective, factual truth in all circumstances whether or not it is distressing to some.

Yes. This. This please.

This judge and Maya's need to compare notes.

Aposterhasnoname · 20/11/2019 12:10

Thank god for a judge that actually gets it!

Datun · 20/11/2019 12:12

I can't help thinking it's awful that we are so surprised and not a little grateful, to find a judge who actually understands the difference between fact and fiction.

And, almost more to the point, who isn't frightened of the trans lobby.

ProfessorSlocombe · 20/11/2019 12:14

.

AutumnCrow · 20/11/2019 12:15

Now on to police powers, and how they can derive from common law but need to be compatible with human rights law and proportionate

BovaryX · 20/11/2019 12:15

freedom of speech is not there to protect statements such as ‘kittens are fluffy’

This judge is great!

LangCleg · 20/11/2019 12:25

I hope 2BoysandaCairn is reading this and learning

I like your optimism!

Datun · 20/11/2019 12:30

Now they are trying to decide where this power to record a 'hate incident' has come from?

I think Harry argued that it is guidelines, not law?

theflushedzebra · 20/11/2019 12:31

Nah - 2boysandaCairn is out saving the world today, whilst simultaneously sorting 500 charity bags Grin

ScrimshawTheSecond · 20/11/2019 12:33

ForeverFaff, sort of like witch pricking?

StoatofDisarray · 20/11/2019 12:36

Someone on the twitter feed has called the judge a t-word.
