I think a lot of European countries still have it basically written into the law that rape must be physically violent and use physical force or it doesn't count. I remember an older MN thread about the law in Germany (I think about the Cologne NYE assaults). Although that is often the real outcome here in practice our law at least does make provision for victims who are unconscious or incapacitated.

An awful verdict - and pleased to see that Spanish women and men are protesting. The Mail does give effective coverage of many assaults on women that you never see covered in the Guardian etc

A stupid law and an awful verdict, but at least they seem to have a better idea of sentencing in Spain.

10 to 12 years

A very quick Google turns up an old (2011) article suggesting the average sentence for rape in the UK is 8 years, which is heartbreaking.

I did some back of an envelope calculations which I don’t expect to be 100% accurate but I think I worked out there were something like 1.5 million rapists in the (UK), given there are some 80-90k people in the prison estate they would have to increase the size of it 900% just to bring only half the number of rapists to justice.

I wonder if the short sentences, failure to prosecute and just the general failure of victims is a fundamentally economically driven policy? Problem is building 9 times more prisons and the attendant running costs increasing is generally a very politically unpopular idea.

That's absolutely right Eresh though the Germans have since updated their law (it's also one of the things that enabled the Guardian to stick to its editorial line of systematically under-reporting the scale of events because technically under German law at the time many of the crimes weren't legally crimes).

Also spot on that before we pay ourselves on the back as a country, we need to remember that while our laws are not bad on paper, in practice they almost never lead to a conviction so something about our system is badly wrong too.

Horrific. That poor child. I really hope there's a push for the law to be changed in light of this case and the other gang rape. What an awful loophole that effectively encourages rapists.
