Yeah, I know people who are 'known for being tactile'. The ones who touch you, see you recoil, but do it anyway because it's 'just their way of being friendly'.

It's simple really. If you know someone doesn't like being touched don't touch them. If you don't know if someone likes being touched or not don't touch them - or, crazy idea here, ask them!

I think it can be a sexual act. It is certainly a very intimate act. And not everybody kisses their relatives on the mouth. The only person I kiss on the lips is my husband and we don't even kiss in public. The thought of a stranger doing it makes me want to gag.

This made me so angry. He's not even denying kissing her against her will yet he's got off scott free. Poor woman won't bother reporting anything else to the police. She didn't even know (or care) who he was and why should it make a difference anyway. The man is a total car crash but he is being enabled by law.

I found this thread after a search and couldn’t log on due to a tech problem. I’ve now seen the attached on the BBC news site TODAY and I’m just so depressed and exasperated. I don’t know what has gone wrong with this prosecution but I just feel for this poor woman. ‘low Level’ assaults like this are not just distressing for the victim but intimidating for other women as it legitimises behaviours that put women off travelling alone and living a life with freedom without restriction. I’m trying to look for any positives here. I have read that other passengers called the police which I guess is a step up from the times I’ve been groped and bystanders have sniggered or turned away. Scraping the barrel here, but I did read the daily fail comments and 90% of them goggled at this outcome as I am. I’m enraged though that Gascoigne is now milking this as the victim.

Big mistake on the part of the prosecution. What happened clearly was not the latter and lacked the sexual intent of the former. It was a common assault and should have gone to a magistrates court. Elevating it to the other 2 bumped it into a jury trial.
