Article in The Times today about this-sorry I don't have a share token but makes depressing reading. The CPS claim that if you have sex with someone, you then by extension consent to them seeing you naked AND FILMING YOU. I don't think this is right at all, don't women have the right to sleep after sex without the fear of being filmed FFS.

The CPS can fuckoff. I guess the ones who made that decision are safe in the knowledge it wont ever be them publicly humiliated that way.

HollowTalk · 16/06/2019 12:20

How can they say that you give permission to filming even when you're asleep? Surely you can't consent to anything if you're asleep? That is such a dangerous thing to say.

TheInebriati · 16/06/2019 12:20

I'm afraid I don't have a share token, but I have no idea how the CPS arrived at this bizarre conclusion;

''Campaigners and MPs have called for a review of voyeurism laws after prosecutors refused to charge a man who admitted secretly filming a woman as she slept naked.''

''Emily Hunt, 39, was told by the Crown Prosecution Service (CPS) that if you have sex with someone, you “by extension” consent to them seeing you naked and filming you, and that she did “not have a reasonable expectation of privacy”.

This is appalling. Who actually are the cps decision makers? Does it go to a panel or is it individuals?

AwdBovril · 16/06/2019 12:24

By extension, then, does that consent include filming consensual sex acts themselves? Pretty bloody short leap from that to revenge porn, if so.

Hirsutefirs · 16/06/2019 12:26

So, if you consent to something, you’ve consented to everything?

Ginandsonic · 16/06/2019 12:29

Taking images of me sleeping naked was one of the things that led to me leaving my husband. It's a gross violation of privacy and trust.

failingatlife · 16/06/2019 12:40

WTFShock so how far does this go? A one night stand could hide a secret camera in your bedroom and that's OK cos they say you naked and asleep onceHmm

TheInebriati · 16/06/2019 13:33

The share token shows this is even worse;

''However, the CPS told Hunt the legislation did not apply in her case because if she consented to “sexual acts” — or could not prove she did not consent — there would be no reasonable expectation of privacy.''

CuriousaboutSamphire · 16/06/2019 13:39

So... what was that other thread about the CPS - that they have deliberateley changed how they choose to deal with rape cases, making many even less likely to come to trial.

This is surely another example of that decison - the one that does not exist, apparently!

LassOfFyvie · 16/06/2019 13:44

''However, the CPS told Hunt the legislation did not apply in her case because if she consented to “sexual acts” —or could not prove she did not consent— there would be no reasonable expectation of privacy.''

That's just nonsense. If she had been awake he would have asked before he took a photograph and she would have said no.

youkiddingme · 16/06/2019 15:21

How long before this is used as 'you agreed to sex' therefore you agreed to any sexual practice, safe or unsafe, that was performed on you and any resulting injuries are just bad luck.

CuriousaboutSamphire · 16/06/2019 15:40

Isn't that pretty much the case now? Thinking of those women who died through violent beatings agreed rough sex... and still comparing them to people who want body modification / piercings but can't agree to be hurt that much in law!

Imnobody4 · 16/06/2019 16:16

So does that mean you can have sex with someone who is asleep aka George Galloway's opinion
I mean not everybody needs to be asked prior to each insertion. Some people believe that when you go to bed with somebody, take off your clothes, and have sex with them and then fall asleep, you're already in the sex game with them.
The CPS is a disgrace. Institutional mysoginy.

jamrollyolly · 16/06/2019 18:22

That's just insane. I consent to sex with my partner, but would never consent to him filming me naked.

How does this relate to our teens/ sexting? We tell our daughters not to take/ have taken naked pics, but this says, if you've had sex you've already consented?!

GrinitchSpinach · 16/06/2019 18:33

Thank you for the share token, TimeLady.

This is absolutely appalling. What's more, she didn't even consent to sex:

The strategy consultant, from Hackney, east London, claims she was drugged and raped by a man who later recorded a 62-second clip of her lying face down on a hotel bed.

A 35-year-old man was arrested on suspicion of rape in 2015 but denied the allegations and was not charged for lack of evidence.

Now prosecutors have refused to pursue a charge of voyeurism, despite the suspect’s admission to police that he recorded the mobile phone video with the intention of using it for sexual gratification and that if Hunt had woken up she would have been “alarmed”.

I have no words.
